About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for a lease renewal by the General Services Administration (GSA) for the Veterans Benefits Administration (VBA) in Lincoln, Nebraska. The GSA currently leases 58,173 ABOA/61,906 rentable square feet at 3800 Village Drive under lease number GS-06P-LNE90043, which expires on 8/31/2025. The justification seeks approval to exercise a five-year renewal option with the incumbent lessor without full competitive bidding.

Market research conducted by PBS using CoStar revealed no alternative locations with sufficient square footage to meet the VBA's requirements. The GSA Lease Contracting Officer advertised the opportunity on SAM.gov from 4/24/2025 to 5/1/2025 and received no responses. The proposed rental rate is deemed fair and reasonable, falling within the current market range. The justification is based on 41 U.S.C. 3304(a)(1), which allows sole-source procurement when only one responsible source can satisfy agency requirements. The government determined that relocating would be more costly and disruptive, and no comparable alternative spaces were identified during the market research process.

U.S. General Services Administration

GSA Region 06

6P1RW Leasing

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 2NE0078

Agency Name: Veterans Benefits Administration (VBA)

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 58,173 ABOA SF/61,906 rentable square feet (RSF) of office space at 3800 Village Drive, Lincoln, NE under lease number GS-06P-LNE90043 for the Veterans Benefits Administration (VBA). The current lease expires 8/31/2025. Approval is requested to exercise a five (5) year renewal option with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for exercising a renewal option are detailed in GSAR 570.401: Renewal Options.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

(INCLUDING ESTIMATED VALUE).

VBA submitted a continuing need letter on April 17, 2025 for 61,906 rentable square feet of office and related space within the Lincoln, NE market. This requirement is for space for a 5-year term with 0 years firm to commence on 9/1/2025. The estimated cost of this lease is per RSF per year for an annual cost of and a total contract value of . There is no vacant Federal Space available.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402. In accordance with GSAR 570.402-4, use of sole source authority is appropriate where the Contracting Officer does not identify any potential acceptable locations through the advertisement or the market survey allowing negotiation directly with the present Lessor.

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement. There are no potentially acceptable locations other than the current location that can meet the agency requirements, as noted in section 7 below.

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402-2, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on 4/24/2025 until 5/1/2025, receiving no responses. In addition, PBS conducted market research using CoStar.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.

N/A

9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

N/A

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

In advance of an existing lease contract’s expiration, considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location, and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or undergo a competitive action.

Additionally, consideration will be given to the customer agency’s mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.
