ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
Procurement Request Number: V411453005MS10
Control Number: S02
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Commander, Littoral Combat Ship (LCS) Squadron TWO requires Simulation training for Littoral Combat Ship (LCS), USS MARINETTE LCS-25. LCS Freedom class ships are built in Wisconsin, and when the ships are delivered they must travel through the Great Lakes and Saint Lawrence Seaway. In the past, a few members of the LCS crew were sent to Quebec to conduct simulator training, specific to the LCS platform and the St. Lawrence transit. This very specific training consists of LCS tailored 4- days of simulator training and shall focus efforts on the safe maneuvering of the LCS through river waters, which are unfamiliar to the crew. The training will also provide simulator training on how LCS should approach and make up to a lock with both one and two tugs. LCS transit 15 locks from Lake Michigan to the Atlantic Ocean. Additionally, pier work will be accomplished with varying river currents to simulate mooring and getting underway in a river port.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
A. X ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. X OTHER REASONS.
The Corporation of Lower Saint Lawrence Pilots Inc., has been identified as the only qualified vendor to provide the required Freedom Variant LCS platform simulator training specific to the waters of the St. Lawrence Seaway, required to navigate ships from the Great Lakes to the sea. This course will be provided by personnel who are experienced with operating the ship in casualty control conditions (single shaft) and has experience taking the ships through the locks in the St Lawrence Seaway and transiting the Welland Canal. The navigation course will provide the proper uses of navigation instrumentation to the crew as requested by the Commanding Officer. It will also bring attention to the Commanding Officer any methods of operation or navigation that appears to be unsafe or in conflict with the International Rules of the Road or sound seamanship practices to comply with 46 U.S.C. Chapter 93 Great Lakes pilotage.
The Quebec City Pilot Training Facility (QCPTF) is the only trainer found that can adequately detail the challenges awaiting the transition prior to SLS transits. Should a navigation course not be utilized for USS Marinette, LCS-25, the crew will be forced to depend upon personnel unfamiliar with U.S. Navy ship handling characteristics to handle the ship in restricted waters to include rivers, the Welland Canal and various St. Lawrence Seaway locks.
