All funding is designated as USFS/Sev. Tax, and bidders were required to acknowledge receipt and acceptance of this amendment with submission of the revised Bid Schedule. Six bid line items (compost transport and purchase, final grade, cement, additional excavator time, and additional limestone) are noted as not guaranteed.

RE: Amendment No. 1 to PKA-16-771

Thank you for your attendance at the Pre-Bid Meeting. The bid submittal date has been changed to Monday July 25, 2016 at 4:00PM. The Bid opening will be at 10:00 AM on Tuesday July 26, 2016. The following clarifications and amendments should be noted and incorporated into the bid documents:

1. Electronic bid submittal via Colorado Vendor Self Service is currently experiencing technical difficulties. Therefore, sealed bids in a single copy are required for submittal to Colorado Division of Reclamation, Mining and Safety, 1313 Sherman Street, Room 215, Denver, Colorado, 80203. Bids can be mailed via Fed-Ex, UPS, other courier service, or hand delivered. Faxed or emailed bids will not be accepted.

2. The linear feet of ten inch (10”) Ertec S-Fence (or approved equivalent) in Task 3.1 is reduced from 1,015 feet to 790 feet. No ten inch S-Fence will be installed at the Upper Site. This reduction is reflected in the Revised Bid Schedule.

3. Task 3.3, Install 14-inch Ertec S-Fence (or approved equivalent) is added to the project.

This new task is reflected in the Revised Bid Schedule. This new Task 3.3 requires installation of 225 linear feet of 14-inch S-Fence at the Upper Site. The S-Fence will be installed in a staggered configuration in the drainage below the Upper Lancaster mine waste pile as directed by the PROJECT MANAGER. The specification and installation of S-Fence under new Task 3.3 is the same as in Task 3.1 except that the S-Fence shall be 14-inches in height (10-inches installed) and installation shall use #8 rebar stakes. Payment for this new Task 3.3 will be made only for the unit price shown under Task 3.3 of the Revised Bid Schedule.

4. Task 4.0, Purchase and Deliver Pulverized Limestone, is reduced from 120 tons to 95 tons.

No pulverized limestone will be incorporated at the Upper Site. This reduction is reflected in the Revised Bid Schedule.

5. Task 5.1, Transport Climax Mine Compost – NOT GUARANTEED, is reduced from 300 cubic yards to 220 cubic yards. No compost will be incorporated at the Upper Site under Task 9.0. This reduction is reflected in the Revised Bid Schedule.

6. Task 5.2, Purchase and Deliver High Country Compost – NOT GUARANTEED, is reduced from 300 cubic yards to 220 cubic yards. No compost will be incorporated at the Upper Site under Task 9.0. This reduction is reflected in the Revised Bid Schedule.

7. Task 6.0, Removal of Building and Structure Debris, is increased from 50 tons to 60 tons.

This increase is reflected in the Revised Bid Schedule. Removal of an engine and associated concrete pad located at the east edge of the lower site are included in this Task

6.0. An asbestos gasket in the engine will be mitigated by others. The concrete pad, following rubblization, may be consolidated into the waste rock under Task 8.0.

8. The uphill two-thirds of the lower waste dump rock berm, Task 7.1, will be replaced through installation of jersey barriers, plastic type, filled with mine waste rock. Ordinary concrete jersey barriers or other massive structural concrete block may be substituted following a written proposal from CONTRACTOR and approval of PROJECT MANAGER. Sufficient jersey barriers or blocks shall be provided and installed in tiers to construct the uphill side of the containment berm. The downhill side of the jersey barriers or blocks shall be completely buried by the remaining one-third of the rock berm described in Task 7.1. The revised estimated material quantities for construction of the rock berm are 120 cubic yards angular rock and 40 cubic yards sand and gravel for void filling.

9. Task 7.2, Upper Waste Dump Rock Berm, is eliminated from the project. This Task 7.2 elimination is reflected in the Revised Bid Schedule.

10. Task 11, Construct Diversion Ditches and Channels, is amended as follows. Hand tools and manual labor are required to install the upland diversion ditch on the historic mine road above the upper mine waste rock dump. Trucks and mechanized equipment must remain on or adjacent to Morgan Gulch Road and foot access only is allowed during work at the upper site, unless otherwise authorized by the PROJECT MANAGER.

All terms and conditions of the Invitation for Bid other than as changed by this amendment remain the same.

Receipt and acceptance of this amendment shall be acknowledged on the bid form and by submitting the revised Bid Schedule.
