On March 5, 2020, the Federal Highway Administration (FHWA) submitted the Construction Stormwater Notice of Intent (NOI) for coverage under the KDHE Construction Stormwater General Permit. Copy of permit application materials are available from FHWA’s office at the Eastern Federal Lands Highway Division, 21400 Ridgetop Circle, Sterling, Virginia, 20166. Upon construction commencement, the contractor will possess all pertinent permit materials on site.

1.3 Sequence of Construction Activity

The scope of the project involves roadway reconditioning (aggregate surface), ditch reconditioning, rehabilitation and replacement of culverts, riprap placement, sign replacement, and miscellaneous work in Kirwin National Wildlife Refuge. Work will encompass approximately 6.5 miles of roadway plus 2 parking lots.

Phase 1: South Side Drive RTE 014 (14+12 to 144+35) Schedule A

1. Install construction traffic control devices required for full road closure at the intersection of the

South Side Drive (RTE 014) and E Cozy Cove Road and at the intersection of South Side Drive (RTE 014) and The Kiln Road (RTE 109). Maintain access for Refuge personnel and emergency vehicles at all times.

2. Perform the following:

a. Removals

b. Drainage

c. Earthwork

d. Resurfacing

Phase 2: South Side Drive RTE 014 (172+00 to 376+38) Schedule B

The primary goal of the SWPPP is to keep soils and contaminants on the project site. To minimize the risks associated with the failure of any key perimeter control, soils and contaminants must be kept as close to their original location as possible. As the project progresses and vegetation and/or permanent erosion control measure are in place, the goal is to keep soils and contaminants in their original location.

1.4 Site Maps

Appendix A contains a map of the project area Appendix B contains copies of the project plan sheets that detail the Erosion Control Plan.

1.5 Soils, Slopes and Drainage Structures

Predominant soil types in the project area are Uly silt loam; Holdrege silt loam; Roxbury silt loam;

McCook silt loam; and Wakeen-Nibson complex.

The project area is generally flat with only minor changes in grades along roadways. There are, however, steeper slopes between roadway embankment and water crossings.

There are 3 drainage structures impacted by this project, all located along S Kirwin Lake Road:

To minimize sediment contamination into the waterways at the pipe replacement locations, floating turbidity curtains will be installed at all three locations using the methods described in FHWA’s standard specifications, FP-14.

There are no inlets or gutters that carry water within the construction area limits.

1.6 Construction Site Area Estimates

The area of disturbance, defined as clearing, grubbing, excavating, and grading that will impact the subgrade, is 2 acres.

The entire project area is approximately 10 acres, including roadway and parking lot reconditioning locations and culvert work. Most work on the roadway will not disturb the subgrade, therefore the disturbed area is much smaller than the project area.

SECTION 2: EROSION AND SEDIMENT CONTROL BMPS

2.1 Erosion Control Devices

The Federal Highway Administration (FHWA) provides payment for specific types of erosion and sediment controls as identified in the contract documents. During the course of the project and depending on site conditions, other types of devices may be utilized and a unit price established via change order. A brief description of typical controls, their purpose, installation and maintenance are included below. Item for which pay items were established on the original contract are denoted by an

a. Temporary Diversion Berms. * Use to divert storm runoff to stabilized slopes or temporary slope drains. Construct temporary berms as shown in the Contract Documents. Compact the berms until no further consolidation is observed, using a dozer track, grader wheel or other equipment.

b. Floating Turbidity Curtain. * Install floating turbidity curtains within a body of water to minimize the migration of silt laden water out of the construction area.

c. Filter Bag. * Furnish rot and mildew resistant bags composed of a non-woven geotextile fabric conforming to Table 713-5 (See FP-14 Standard Specifications).

d. Fiber Roll. * Furnish and install fiber roll in accordance with FP-14 713.12 and 157.06.

e. Stabilized Construction Exit * Maintain stabilized construction exits to minimize tracking of soil onto existing roads.

f. Temporary Soil Stabilization Apply seed and mulch for soil erosion protection at the rates shown in Table 157-1 of FP-14. Protect and care for seeded areas, including watering, until permanent turf establishment is in place.

g. Permanent Soil Stabilization * Control erosion on completed slopes in accordance with FP-14 Section 157.13.

Locations of each BMP are identified in the construction plans. Refer to Appendix B.

Additional specifications for erosion prevention and sediment control are addressed in FHWA’s standard specifications, FP-14 SECTION 157, a copy of which is located in Appendix D.

2.2 Implementation

Sequencing

Phase I Establish Perimeter Controls Prior to any clearing, grubbing, or excavation, construct perimeter controls to ensure that disturbed sediment does not leave the project site. Perimeter controls include fiber rolls and other specified measures outside the construction limits.

Phase II Intermediate Controls Apply intermediate controls during rough grading operations. Install fiber rolls in areas surrounding the existing culverts as called out in the plans.

At the end of each day's grading operations, shape earthwork to minimize and control erosion from storm runoff.

Provide fiber roll around all stockpiled excavated roadway material. Apply temporary turf establishment to stockpiles remaining in place longer than 14 days within 7 days of stockpiling.

Provide watering for dust control within the construction limits, on active haul roads, and in pits and staging areas.

Phase III Final Construction/ Stabilization After completion of roadway construction, finish grading slopes.

After completion of storm water drainage construction, remove filter bag, diversion berm, and fiber roll.

Remove all other perimeter controls when directed by the contracting officer (CO).

General Guidelines

Perimeter controls for each work area will be installed prior to removing vegetation or manipulating the earth from its current state in those areas. If the perimeter control is distanced from the active work area, it will also be installed prior to commencement of work.

Exceptions are as follows:

• If implementation of erosion and pollution control measures is precluded by snow cover, undertake such measures as soon as practical.

When construction activities on steep slopes (slopes of forty (40) percent or greater) cannot be avoided, the contractor must immediately initiate placement of appropriate erosion control BMPs in any exposed steep slope areas where construction activities have permanently or temporarily ceased, and will not resume for a period exceeding 7 calendar days. For vegetative cover areas, in addition to seeding, watering, mulching, and any other required activities related to the planting and establishment of vegetation, other appropriate erosion control practices such as geotextiles or erosion control mats shall be utilized. Diversion of concentrated or channelized stormwater flows around steep slopes or slope drains shall be utilized where feasible.

Vegetation shall be preserved where practical. The time period for soil areas to be without vegetative cover is to be minimized to the extent practical.

Clearing and grubbing within 50 feet of a defined drainage course shall be avoided, if feasible. Where changes to defined drainage courses are to occur as part of the project, clearing and grubbing within 50 feet of the defined drainage course shall be delayed until all materials and equipment necessary to complete the drainage change are on site. Changes to defined drainage courses shall be completed as quickly as possible once the work has been initiated. The area impacted by the construction of the drainage course change is to be re-vegetated or stabilized to minimize the length of time the area is exposed.

Contractor shall implement the following measures in accordance with Kansas NPDES General Permit Section 7.2.9:

(1) Minimize the discharge of pollutants from equipment and vehicle washing, wheel wash water, and other wash waters. Wash waters must be free of detergents, soaps, or solvents and must be treated in a sediment basin or alternative control that provides equivalent or better treatment prior to discharge;

(2) Minimize the exposure of building materials, building products, construction wastes, trash, landscape materials, fertilizers, pesticides, herbicides, detergents, sanitary waste and other materials present on the site to precipitation and to stormwater except where the exposure to precipitation and to stormwater will not result in a discharge of pollutants, or where exposure of a specific material or product poses little risk of stormwater contamination (such as final products and materials intended for outdoor use);

(3) Minimize the discharge of pollutants from spills and leaks and implement chemical spill and leak prevention and response procedures;

(4) Require the contractor to provide solid and hazardous waste management including:

providing trash containers and regular site clean-up for proper disposal of solid waste such as scrap building material, product/material shipping waste, food containers, and cups; and providing containers and proper disposal for waste paints, solvents, and cleaning compounds;

(5) Require portable toilets for proper disposal of sanitary sewage;

(6) Require storing construction materials away from drainage courses and low areas;

(7) Require containment berms and drip pans at fuel and liquid storage tanks and containers;

2.3 Maintenance, Inspection, Documentation and Removal

Maintenance

Fiber roll – Inspect for buildup of excess sediment, undercutting, sags, and other failures. If the fabric becomes damaged, repair or replace as necessary. Remove sediment from behind the fiber roll when it becomes .5 feet deep at the fence.

Filter bags – Check the filter bags daily during dewatering operations for punctures, tears, or other damage, and check for capacity. Immediately cease pumping and replace damaged filter bags, or bags that have reached their rated capacity.

Diversion berms – Inspect and maintain the temporary diversion berm daily. Repair as needed after rainfall events or as directed by the CO.

Inspection and Documentation

The temporary erosion and pollution control devices need to maintain their effectiveness as long as required to contain sediment runoff. The temporary erosion and pollution control devices will be inspected and an inspection report completed every 7 days and within 24 hours of a rainfall event of .25 inch or more. The temporary erosion and pollution control devices will be monitored daily during prolonged rainfall. Any damaged measures shall be repaired or replaced by the end of the day.

Within 24 hours after each inspection, contractor shall submit an inspection report to the CO. Include the following:

(a) Date and time of the inspection;

(b) Names and titles of persons making the inspection;

(c) Summary of the inspection;

(d) Weather since the last inspection or since the start of work, if the first inspection. For each storm event, include the beginning date and time, duration, rainfall quantity in inches (millimeters), and whether discharge occurred;

(e) Weather and description of discharges occurring during the inspection;

(f) Locations of discharges or other pollutants from the site;

(g) Locations of erosion and sediment control measures that need maintenance;

(h) Locations of erosion and sediment control measures that failed to operate as designated or proved inadequate for a particular location;

(i) Locations where additional erosion and sediment control measures are needed; and

(j) Other necessary corrective actions including action taken, locations, dates, and times.

Contractor shall maintain temporary erosion and sediment control measures in working condition until the project is complete or the measures are no longer needed. Remove sediment trapped in perimeter protection control measures before deposits reach 50 percent of the above ground height. Remove sediment from sediment retention structures when their capacity is reduced to 50 percent of design capacity. Use removed sediment in the work if acceptable or dispose of it according to Subsection

204.14 of FP-14.

Replace erosion and sediment control measures that cannot be maintained and those that are damaged by construction operations.

Removal

Remove and dispose of temporary erosion and sediment control measures when vegetation is satisfactorily established and drainage ditches and channels are lined and stabilized. Remove and dispose of erosion and sediment control measures according to Subsection 203.05 of FP-14.

Restore the ground to its natural or intended condition and provide permanent erosion control measures.

SECTION 3: FINAL STABILIZATION

Final Stabilization will include the installation of aggregate ditch liners slope protection, rip rap, and permanent seeding. Aggregate and concrete protection will be constructed during the course of the project in conjunction with its respective phase and in unison with temporary erosion control measures being implemented at the same time. Permanent seeding and vegetation of the project will be performed as soon as possible upon completion of the earthwork, but within established planting seasons

SECTION 4: CERTIFICATION

This SWPPP was prepared to meet all state and federal requirements. Any requirement not realized at the time of the original plan development will be included via amendment(s) at the time of realization.

Project Description

Project KS FTFW KIRW 14(1)104(1) consists of roadway rehabilitation and parking area improvements. Roadway reconditioning, aggregate surface, ditch reconditioning, drainage culverts, riprap, signing, and other miscellaneous work. The project includes the routes as follows:

Soil disturbing activities include drainage construction and 1 foot on each side of the roadway was included to account for the varying width of the existing roadway. The total disturbed area for the project is approximately 2 acres.

The receiving water is Bow Creek.

Prohibited Discharges

The following discharges are prohibited:

Wash-water from concrete, paint, curing compounds, and other construction materials Fuels, oils, equipment-related compounds Soaps, solvents used for vehicle washing Waste, garbage, sanitary waste

Inspect and maintain on a regular basis, all mechanized equipment used in or near surface water to prevent contamination from fuels, lubricants, hydraulic fluids, or other toxic materials.

Solid waste generated from the project will consist of construction debris, garbage, and empty containers. Collect and store all waste in dumpsters, or in metal or plastic drums, as appropriate.

Hazardous waste will not be generated from normal construction activities. Equipment fueling and maintenance could generate spills, leaks, and hazardous wastes like motor oil, diesel, gasoline, and battery fluid. If feasible, conduct these activities in a covered area to avoid contact with storm water. Store all hazardous waste materials in appropriate and clearly marked containers away from other non-waste materials. Do not dispose of hazardous waste materials into the on-site dumpsters. Dispose of material according to Federal, State, and local regulations.

Develop and implement a Spill Prevention Control and Countermeasures (SPCC) plan following the requirements under 40 CFR 112. Report spills large enough to discharge to surface waters to the National Response Center at 1-800-424-8802.

General Guidelines

The Erosion & Sediment Control Narrative is meant as a guideline for preventing erosion and controlling sediment. The work consists of applying measures throughout the life of the project to control erosion and to minimize the sedimentation of rivers, streams, and impoundments such as lakes, reservoirs, bays, and coastal waters. The measures consist of soil erosion control measures which are also defined and outlined in the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-14, and the Special Contract Requirements.

Do not modify the type, size, or location of any control or practice without prior approval from the Contracting Officer (CO).

No construction access will be permitted through a wetland or waterway.

Do not allow construction vehicles to track sediment outside the project limits.

Do not allow any construction equipment to operate on or access the down-slope side of the perimeter control measures.

Direct storm water to vegetated buffer areas and do not discharge directly into surface waters.

Sequence of Construction

Phase I Establish Perimeter Controls

Prior to any clearing, grubbing, or excavation, construct perimeter controls to ensure that disturbed sediment does not leave the project site. Perimeter controls include fiber rolls and other specified measures outside the construction limits.

Phase II Intermediate Controls

Apply intermediate controls during rough grading operations. Install fiber rolls in areas surrounding the existing culverts as called out in the plans.

At the end of each day's grading operations, shape earthwork to minimize and control erosion from storm runoff.

Provide fiber roll around all stockpiled excavated roadway material. Apply temporary turf establishment to stockpiles remaining in place longer than 14 days within 7 days of stockpiling.

Provide watering for dust control within the construction limits, on active haul roads, and in pits and staging areas.

Phase III Final Construction/ Stabilization

After completion of roadway construction, do the following as directed by the CO:

Finish grading slopes.

After completion of storm water drainage construction, do the following as directed by the CO:

Remove filter bag, diversion berm, and fiber roll.

Remove all other perimeter controls when directed by the CO.

Maintenance and Inspection Procedures

Unless stated otherwise, construct and maintain all vegetated and structural erosion control practices according to Section 157, the details shown in the plans, and the individual permitting requirements.

Check and maintain erosion control measures once every 7 days and within 24 hours after a rain of

0.25 inches or more, and daily during wet weather. Repair or replace any damaged measures by the end of the day.

Fiber roll - inspect for buildup of excess sediment, undercutting, sags, and other failures. If the fabric becomes damaged, repair or replace as necessary. Remove sediment from behind the fiber roll when it becomes 0.5 feet deep at the fence.

Filter bags - check the filter bags daily during de watering operations for punctures, tears, or other damage, and for capacity. Immediately cease pumping and replace damaged filter bags, or bags that have reached their rated capacity.

Diversion berms - inspect and maintain the temporary diversion berm daily. Repair as needed after rainfall events or as directed by the CO.

Stabilized Construction Exit - Inspect the exit area weekly after heavy rains and/or heavy use. Remove and sediment tracked or washed onto public roads immediately. Reshape pad as needed for proper drainage runoff control.

Turbidity Curtain - Inspect the curtain and floats weekly. Repair any deficiencies as needed to ensure turbid water is not flowing into the larger body of water.

Record the inspection date and summary of findings within 24 hours of completing a site inspection.

1. Install the turbidity curtain before construction activities begin.

2. Do not install the turbidity curtain where the flow of water will remove accumulated sediment or significantly move the curtain.

3. Select a turbidity curtain type to suit the site conditions and meet erosion control and water quality requirements.

4. Install turbidity curtain stakes in a vertical position unless otherwise directed by the CO.

5. Provide 3 inches of freeboard to the top of the turbidity curtain.

6. For Types 1 and 2, extend the synthetic fabric skirt through the entire depth of the water (to the channel bottom) unless tidal conditions are present.

Construction Requirements

157.03 Qualifications. Submit the following for approval at least 14 days before earth disturbing operations begin:

(a) Names of personnel responsible for soil erosion and sediment control; and

(b) A résumé for each individual describing their knowledge and experience providing erosion and sediment control and pollution prevention on highway or road construction projects for at least 5 years.

Include certifications in those states where applicable.

157.04 General. Provide soil erosion and sediment control measures according to the contract erosion and sediment control plan, contract permits, Section 107, and this Section. Contract permits amend the requirements of this Section. Do not modify the type, size, or location of controls or practices without approval.

The erosion and sediment control plan reflects special concerns and measures to protect resources. An alternate erosion and sediment control or stormwater pollution prevention plan, with necessary permits, may be submitted for approval according to Subsection 104.03. Submit alternate erosion and sediment control proposals at least 30 days before their intended use.

When soil erosion and sediment control measures are not functioning as intended, take corrective action to eliminate or minimize pollutants in stormwater discharges from the project.

If wood chips are used, do not import without approval from the CO.

157.05 Controls and Limitations on Work. Before grubbing or grading construct sediment controls around the perimeter of the project including filter barriers, diversion, and settling structures.

Limit the combined grubbing and grading operations areas to 8 acres (3.2 hectares) of exposed soil at one time.

Construct and implement soil erosion and sediment control measures as follows:

(a) Construct temporary controls in incremental stages as construction proceeds;

(b) Construct temporary slope drains, diversion channels, and earth berms to protect disturbed areas and slopes;

(c) When a soil disturbing activity within a portion of the project is complete, apply permanent measures to the finished slopes and ditches within 14 days;

(d) When a soil disturbing activity within a portion of the project has temporarily ceased, apply temporary measures within 14 days;

(e) Construct outlet protection as soon as culverts or other structures are complete;

(f) Construct and maintain soil erosion and sediment controls on and around soil stockpiles;

(g) Following each day’s grading operations, shape earthwork to minimize and control erosion from stormwater runoff; and

(h) Maintain stabilized construction exits to minimize tracking of soil onto existing roads.

157.06 Filter Barriers. Construct silt fence, berms, and fiber rolls and socks to reduce the velocity of runoff to allow sediment to settle.

157.07 Sediment Retention Structures. Construct sediment retention structures of the following types:

(a) Temporary sediment traps. Construct temporary sediment traps to detain runoff from disturbed areas and settle out sediment. Provide outlet protection.

(b) Sediment basins. Construct sediment basins to store runoff and settle out sediment for large drainage areas. Excavate and construct sediment basins according to Section 204. Construct riser pipes according to Section 602. Provide outlet protection.

157.08 Outlet Protection. Construct riprap aprons or basins to reduce water velocity and prevent scour at the outlet of permanent and temporary erosion and sediment control measures. Construct riprap according to Section 251.

157.09 Water Crossings. Construct temporary culvert pipe at temporary crossings where construction vehicles cross a live waterway.

157.10 Diversions. Construct temporary channels, temporary culverts, earth berms, or sandbags to divert water around disturbed areas and slopes. Use temporary channels, temporary culverts, pumps, sandbags, or other methods to divert the flow of live streams for permanent culvert installations and other work.

Stabilize channels according to Subsection 157.11. Provide outlet protection.

157.11 Waterway and Slope Protection and Stabilization. Use the following:

(a) Plastic lining. Use plastic lining to protect underlying soil from erosion. Place the plastic lining loosely on a smooth soil surface free of projections or depressions that may cause the liner to puncture or tear. Lap transverse joints at least 3 feet (1 meter) in the direction of flow. Do not use longitudinal joints. Anchor the lining in place using riprap, gravel bags, or sandbags.

(b) Riprap. Construct riprap for channel lining according to Section 251.

(c) Check dams. Construct riprap, gravel bags, sandbags, fiber rolls and socks, or earth berms for temporary check dams to reduce the velocity of runoff in ditches and swales.

(d) Rolled erosion control products. Use rolled erosion control products to stabilize waterways and slopes before or after temporary or permanent seeding. Install according to Section 629.

(e) Temporary slope drains. Use drainpipe, riprap, or plastic lined waterway for temporary slope drains to channel runoff down slopes. Channel water into the slope drain with an earth berm, gravel bag, or sandbag headwall constructed at the top of a cut or fill. Anchor slope drains to the slope.

Provide outlet protection.

(f) Floating turbidity curtains.
