4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.

DATED 9/24/2024.THE APPROVAL FOR THE LASER DOES NOT AUTOMATICALLY EXTEND TO

OTHER LASER SYSTEMS BY OTHER MANUFACTURERS DUE TO THE SPECIFIC SAFETY

STANDARDS INVOLVED AROUND THE HIGH POWER LIGHT SOURCE NEEDED TO SAFELY

REMOVE THE PAINT, CORROSION AND OTHER SURFACE CONTAMINATES FROM SELECT STEEL

SURFACES. IF A DIFFERENT MANUFACTURERS LASER WAS PURCHASED IT WOULD NOT BE

PERMITTED TO USE AT PSNS AND THEREFORE WOULD BE GROUNDS FOR REJECTION BASED

ON SAFETY COMPLIANCE.

[ X ] A market survey was not conducted due to: Lasers have a specific approval process by C/106 and do not automatically extend to other manufacturers products despite similar appearance. The lasers are approved based on strength, portability and employee safety (Eye/Skin) using the lasers with additional concerns as to how the laser will impact the structural strength of the steel surfaces it is used on. This is a special concern for removal of surface contaminates on submarines.
