JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING AGENCY: The responsible contracting agency is the U.S. Army Corps of Engineers, Northwestern Division, Omaha District, Contracting Division (CENWO-CT), 1616 Capitol Avenue, NE 68102.
2. DESCRIPTION OF ACTION: A negotiated, firm-fixed price supplemental agreement (modification), on contract W9128F-16-D-0050, W9128F20F0316, Ft Logan Roadway Renovation & Repair, Fort Logan National Cemetery, Denver, Colorado to John Bowman, Incorporated (JBI), to provide removal and new construction of Shelter B Parking Approach. The original contract was awarded using FY18 VA funds and is currently scheduled for completion in late April 2021 with a current contract amount of $958,150. No funds will be used to award the supplemental agreement, it will be awarded at no cost from negotiations with the Contractor where credits for not using P6 Primavera will be applied towards this work.
3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:
a. The current USACE contractor, JBI, is under contract to design renovation and repair of all roads, curbs, gutters and Committal Shelter parking areas and parking approaches at Fort Logan for CLIN 0001.
For CLIN 0002 they are under contract to construct the full depth replace and repair streets, curbs, and gutters for the road Omaha DR-10. The type of work and materials required of the current USACE contract and the proposed work are similar in nature - i.e. they both require removal and replacement of asphalt, concrete and curbs and gutters. The USACE contractor (JBI) will be able to do the entirety of the work with the current paving subcontractor.
b. The work performed under the supplemental agreement involves widening the parking approaches by removing and replacing curbs, asphalt, and concrete pans/v-ditches.
c. Original estimate for this work is $25,000 - which is below the Simplified Acquisition Threshold (SAT) of $250,000 - and is less than 1% of the current USACE contract value. It is estimated that the USACE contractor could execute this work concurrently with the awarded work, resulting in no additional days to their contract duration.
d. Upon approval, the USACE contractor (JBI) would be asked to provide proposal reflecting credit and pricing to complete the scope identified in Item 3b above.
4. AUTHORITY CITED:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements” due to the potential of duplication of costs to the Government and unacceptable delays in fulfilling the agency’s requirements.
5. REASON FOR AUTHORITY CITED: John Bowman, Inc. has been selected based on the following rationale:
a. On 8 January 2021, USACE learned that the VA wished to add Committal Shelter B Parking Approaches.
b. Portions of the newly paved street and reworked curbs would have to be torn out/demolished to install the parking approaches and this is a waste of time and funds and jeopardizes new work on Omaha DR- 10.
c. Utilizing one contractor would reduce the risks and liabilities of construction.
d. Overall cost to the Government would be reduced by utilizing the contractor who is already mobilized to the site and performing work that ties into this modification.
e. The warranty of construction would remain intact for the entire paved area involved in the contemplated work, because ultimate responsibility would remain with the original contractor.
f. The work can be executed timely through the current contractor, enabling the facility mission to be achieved.
g. If this supplemental agreement is not approved, the VA would duplicate scope and services to plan, acquire, and execute a separate contract to widen these parking approaches. The Government would be duplicating costs for the scope of work.
6. EFFORTS TO OBTAIN COMPETITION: The original contract was competed full and open.
Competition provided best value to the Government.
7. ACTIONS TO INCREASE COMPETITION: None.
8. MARKET RESEARCH: Limited market research was conducted for this proposed supplemental agreement. RS Means was consulted to determine the approximate anticipated cost for this contract modification.
9. INTERESTED SOURCES: To date, no other sources have expressed an interest in writing however, all offers received shall be considered. All notices required by FAR 5.201 shall be published and any offers or proposals received shall be considered.
10. OTHER FACTS: None.
