About this file
This is a Contracting Officer's Determination document for a sole source procurement by the U.S. Army Corps of Engineers, Pittsburgh District. The document justifies limiting competition for construction services to repair the Delta Ramp at Avon Park Air Force Range in Florida, which sustained damage in 2023 during heavy equipment operations by the Advanced Contractor Initiative Temporary Emergency Power prime contractor. The contract vehicle is a fixed-price purchase order funded through FEMA Reimbursable funds for Fiscal Year 2026, with an anticipated period of performance of 60 calendar days from award.
The scope of work encompasses three repair tasks on the airfield pavement: Task 1 applies a Gilsonite Modified Asphalt Emulsion Seal Coat (GSB-88) to 4,875 square feet of pavement with surface gouges and abrasions; Task 2 involves a partial depth repair (2-inch mill and patch) of 12,938 square feet affected by petroleum product spills and depressions; and Task 3 includes coring and patching three distinct locations with small, isolated depressions. The contracting officer justified sole-source selection of WSP USA Solutions, Inc. (located at 1300 17th St N, Suite 510, Arlington, VA 22209-3804) under FAR 12.201-1 based on unique circumstances: WSP, as the ACI-TEP prime contractor responsible for the original damage, is the only source capable of simultaneously performing repairs while settling the Government's liability claim through a negotiated cost-sharing agreement, thereby avoiding duplicative processes and achieving streamlined resolution. The determination was signed on June 30, 2026, and will be posted to the Government Point of Entry.
