4. Authority Cited: FAR 16.505(b)(2)(i)(E) – Statute expressly authorizes or requires that the purchase be made from a specified source. This procurement shall be placed on beta.SAM.GOV to accept bids from all small businesses providing the VEX Robotics brand kits.
5. Reason for Authority Cited: USACC OPORD 19-03-004 dated 04 March 2019, USACC Annual Training Guidance Academic Year (AY) 19-20. Requires schools teach, train and compete using VEX Robotic Kits.
Specifically, the USACC Annual Training Guidance for Academic Year (AY) 19-20 dated 04 March 2019 and signed by the USACC Commanding General authorizes JROTC to participate in VEX Robotics competitions. The VEX brand name is the only recognized brand to participate in those competitions based on the VEX Competition Inspection checklist. Any other brand of robotics kits have been excluded from VEX Robotics competitions which JROTC attends.
6. Actions to Increase Competition: Contract action is a brand name restriction and will be open for competition to those selling VEX Robotic Kits. Until Vex Robotics competitions allows other brands of robotics kits in their competition, Cadet Command must continue to use Vex brand robotics kits to compete in Vex Robotics competitions. This buy will be open to all small businesses who sell VEX robotics kits.
7. Market Research: The market research for this action was limited to VEX Robotics sellers. In order to ensure we obtain robotics kits that can qualify to compete in the JROTC VEX Championships, no other brands were considered.. Market research has revealed that at least half of a dozen vendors sell the VEX brand of robotics kits. If a different brand of robotics kit is purchased, it will fail to meet the standards required to enter a VEX robotics competition, be inconsistent with other JROTC schools across the country who currently use VEX Robotics in the classroom and in competition and not be IAW USACC Annual Training Guidance.
