About this file

This is a Request for Qualification (RFQ) document issued by Kaufman County, Texas for selecting a Design-Build Entity to construct a new Juvenile Facility. The project involves planning, design, preconstruction activities, and construction services for a ground-up, approximately 37,800 square foot facility located in Kaufman County. The facility will provide 32 secure housing beds and support functions including classrooms, medical and counseling spaces, administrative offices, visitation areas, intake/booking, and recreation areas. The RFQ will be conducted as a two-step best value selection process, with RFQ responses due on November 20, 2025 at 3:00 PM. The estimated construction cost is $32 million, with the County planning to shortlist up to three Design-Build Entities for the Request for Proposals (RFP) stage, with a targeted Notice of Intent to Award on January 23, 2026 and a Notice to Proceed for Phase 1 on February 27, 2026.

The procurement will follow Texas Government Code Chapter 2269, Subchapter G, which authorizes the Design-Build delivery method. The project requires prevailing wage compliance under Texas Government Code Chapter 2258, and all architectural drawings must be prepared by a Texas Registered Architect, with engineering drawings prepared by Texas Licensed Professional Engineers. The Design-Build Entity must provide performance and payment bonds, with a minimum bonding capacity equal to the project's estimated construction cost. Kitchell CEM, Inc. has been retained by the County to provide Owner's Representation and Program/Construction Management services. The selection will be based on both qualifications and cost, with a comprehensive scoring framework evaluating the Design-Build Entity's experience, organizational performance, claims history, regulatory compliance, and reference interviews.

NOTICE OF QUALIFICATION REQUIREMENTNotice of Qualification Requirement

In accordance with this Notice of Request for Qualifications (“RFQ”), Kaufman County (“County”) hereby gives notice that it is issuing this RFQ to evaluate the qualifications of Design-Build Entities and their proposed Design-Build Teams for the purpose of selecting a Design-Build Entity to provide Design-Build services for the new 32-bed Kaufman County Juvenile Facility.

Through this RFQ, the County invites the submission of Statements of Qualifications (SOQs) from corporations, limited liability companies, partnerships, joint ventures, or other legal entities capable of providing appropriately licensed contracting, architectural, and engineering services to plan, design, and construct the Project under the Design-Build delivery method authorized by Texas Government Code Chapter 2269, Subchapter G (§2269.301 et seq.).

The procurement will be conducted as a two-step best value selection process in accordance with §2269.305–§2269.307. The selected Design-Build Entity (“Design-Builder”) will deliver the Project with its Design-Build Team, which includes the Design-Build Entity itself and the individuals and other entities identified by the Design-Build Entity as members of its core team.

GENERAL DESCRIPTION OF THE PROJECT

The Work includes, but is not limited to, planning, design, preconstruction activities, and construction services for the new Kaufman County Juvenile Facility, a ground-up, approximately 37,800 square foot facility located in Kaufman County, Texas.

The facility will provide 32 secure housing beds along with a full complement of support functions including classrooms, medical and counseling spaces, administrative offices, visitation areas, intake/booking, and recreation areas. The design and construction shall comply with all applicable state and local building codes, juvenile facility standards, and energy code requirements.

The estimated construction cost is Thirty-Two Million Dollars ($32,000,000).

In accordance with the provisions of the Texas Occupations Code, all architectural drawings must be prepared, signed, and sealed by a Texas Registered Architect, and all engineering drawings must be prepared, signed, and sealed by Texas Licensed Professional Engineers.

The County will procure this project using the Design-Build delivery method authorized by Texas Government Code Chapter 2269, Subchapter G, which provides for a two-step qualifications-based selection process followed by submission of detailed proposals from shortlisted firms.

Kaufman County has retained Kitchell CEM, Inc. to provide Owner’s Representation and Program/Construction Management services in support of this Project.

BEST VALUE DESIGN-BUILD ENTITY EVALUATION AND SELECTION PROCESS

In accordance with Texas Government Code Chapter 2269, Subchapter G (§2269.301 et seq.), the County will select a Design-Build Entity (“Design-Builder”) to provide planning, design, preconstruction services, and construction of the Project using a public, two-step, qualifications-based best value selection process:

· Step 1 – Request for Qualifications (RFQ): The County will evaluate Statements of Qualifications submitted by responsible Design-Build Entities and their identified Core Team Members in accordance with §2269.307. Scoring of Step 1 will be conducted as provided in this RFQ.

· Step 2 – Request for Proposals (RFP): The County will invite the highest-ranked Design-Build Entities, not to exceed three (3) firms as permitted under §2269.305, to participate in the RFP stage. In Step 2, shortlisted entities will submit detailed proposals including Design and Construction Qualifications, Technical Expertise, Pre-Construction Services to GMP Price Proposal, and participate in an Interview/Presentation.

The County will issue Step 2 documents separately to shortlisted entities by RFP or Addendum. Consistent with §2269.305, the County intends to award the Design-Build contract on a best value basis, considering both qualifications and cost in determining the proposal most advantageous to the County.

QUALIFICATION REQUIREMENTS

It is mandatory that all Design-Build Entities complete the Qualification Questionnaire, provide ALL materials requested herein, and be “qualified” by the County to be included in the RFP shortlist. No proposal will be accepted from a Design-Build Entity that has failed to comply with the requirements of the Qualification Document.

Qualification Questionnaires that fail to clearly present ALL of the requested information, present false or misleading information, or are not submitted in the format requested may be considered nonresponsive and rejected on that basis.

The County’s qualification determinations will be based on objective evaluation criteria. However, neither the fact of qualification, nor any qualification rating, will preclude the County from additional post-proposal consideration and determination of whether a bidder has demonstrated the requisite trustworthiness, quality, fitness, capacity and experience to satisfactorily perform the proposed Project work.

DEFINITION OF WHAT COMPRISES A DESIGN-BUILD ENTITY

A “Design-Build Entity” is a sole proprietorship, partnership, corporation, or other legal entity (or team of such entities) that proposes to enter into a single contract with the County to provide both design and construction services for a public construction project. In accordance with Texas Government Code §2269.301(1), a Design-Build Entity must furnish architectural or engineering design services, as well as construction services, either by employing licensed professionals directly or through subcontracting with appropriately licensed providers.

For purposes of the Project qualification, each Design-Build Entity must identify and provide information for certain Core Organizations. The Core Organizations, listed below, must individually complete the appropriate, scored-question portions of the Qualification Questionnaire and obtain a passing score for the Design-Build Entity as a whole to be qualified. The Core Organizations that must be listed for Qualification are:

1. General Contractor (GC)
1. Architect (A/E)
Core Sub-Contractors
Core Sub-Consultants
1. N/A
1. Mechanical Engineer

1. Electrical Engineer

1. Plumbing Engineer

The Core Organizations identified in response to this Qualification Document must be selected by each Design-Build Entity on the basis of demonstrated qualifications. In accordance with Texas Government Code §2269.307 and §2269.308, the services of subcontractors and consultants who are not designated as Core Organizations during the qualification process shall be procured by the Design-Build Firm after selection, consistent with applicable state law. If a Core Organization proposed by the Design-Build Entity has the capability of performing both design and construction services (for example, a subcontractor that employs licensed engineers and design professionals), that organization must meet all applicable qualification requirements within the Qualification Questionnaire for each discipline it intends to perform.

IMPORTANT PROVISIONS OF THE PUBLIC CONTRACT CODE RELATED TO QUALIFICATION

The County intends to request competitive sealed proposals for Design-Build services to construct the Project pursuant to Texas Government Code Chapter 2269, Subchapter G, which authorizes the use of the Design-Build method of procurement for public construction projects. This Qualification Document establishes the standardized qualification procedure required by Texas Government Code §2269.307.

In accordance with §2269.307 and related provisions, the County has prepared the attached Qualification Questionnaire based on best practices and statutory requirements for Design-Build procurements in Texas. Accordingly, the qualification procedure described herein: (1) provides a standardized Qualification Questionnaire, (2) adopts and applies a uniform system for rating Design-Build Firms on objective criteria, and (3) establishes an appeals procedure, by which a Design-Build Firm that is found to be not responsive during the Qualification Phase may dispute that determination.

Except for the Contact Information section (Subpart I.A) of the Qualification Questionnaire, which will be considered a public record, completed Qualification Questionnaires and all required attachments submitted by Design-Build Firms during the Qualification Phase shall not be open to public inspection pursuant to Texas Government Code §2269.055. The County will keep all such information confidential to the extent permitted by state and federal law. However, the County reserves the right to disclose submitted qualification information selectively to third parties for purposes of verification, investigation of substantial allegations, or in an appeal hearing.

COUNTY OF KAUFMAN RESERVATIONS

The County may refuse to grant qualifications where the requested information and materials are not provided or not provided by the date specified above. There is no appeal from a refusal for an incomplete or late application. The closing time for RFQ proposals will not be changed to accommodate supplementation of incomplete submissions or late submissions. If the County determines that any information provided in a Qualification Questionnaire is false or misleading or is so incomplete as to be false or misleading, the Qualification Questionnaire may be rejected. This is consistent with Texas Government Code §2269.055, which authorizes governmental entities to reject a proposal that does not comply with the published requirements.

The County reserves the right to accept qualification applications despite minor irregularities and omissions in the information which would otherwise serve to disqualify a Design-Build Firm. The County reserves the right to make all final qualification determinations and to determine at any time that the qualification procedures will not be applied to the Project. Nothing herein obligates the County to proceed with a Design-Build contract award. See Texas Government Code §2269.251, which provides discretion for the governmental entity in determining the selection process and award.

The County reserves the right to adjust, increase, limit, suspend, or rescind a Design-Build Firm’s qualification rating based on subsequently learned information. Design-Build Firms whose rating changes sufficiently to disqualify them will be notified and given an opportunity for a hearing consistent with the hearing procedures described herein for appealing an initial qualification determination. In accordance with Texas Government Code §2269.307, qualification procedures must provide a uniform system of rating and an appeals process, which this document establishes.

The County may require Design-Build Firms that will be using subcontractors who are not part of the Design-Build Team’s Core Organization to: (1) submit the qualifications of certain subcontractors as specified in the proposal documents, and (2) participate in post-bid qualification review. Compliance with such requirements, if imposed, will follow acceptance of a proposal but must occur before a contract award is made, consistent with Texas Government Code §2269.308, which governs the evaluation of qualifications of Design-Build subcontractors and consultants.

REVIEW AND NOTIFICATION PROCESS

The completed Qualification Questionnaire with required attachments must be submitted by the deadline specified below. Once received, the review and notification process will be as follows:

1. Receipt: The original Qualification Questionnaire with required attachments will be stamped upon receipt with an official date and time of receipt.

1. Completeness Review: Each qualification submission will be reviewed for completeness within THREE (3) calendar days from the deadline date. If the qualification submission is complete, it will proceed to Review and scoring.

1. Review: Complete Qualification Questionnaire with required attachments will be reviewed by County within FIVE (5) calendar days from the submission deadline date.

1. Qualification Notification: The Design-Build Entity will be notified of their qualification ranking by electronic email.

If the Design-Build Entity is rated as “Qualified” for the Project and ranks in the top three for RFQ scoring, it will be “eligible” for proposing on the Project and will be notified of the opportunity to participate in the RFP process when the proposal documents are issued. If the Design-Build Entity is rated as “Non-Qualified” for this Project, it may initiate an appeal process as described below.

Failure to pay the prevailing wage rate may result in the penalties provided under §2258.051.

EXPLANATION OF SCORING FRAMEWORKExplanation of Scoring Framework

The qualification determination for a Design-Build Entity will result from consideration of the scores attained in all parts of the Qualification Questionnaire.

PART I: INFORMATION ABOUT THE DESIGN-BUILD ENTITY AND EACH OF ITS MEMBERS

Part I applies to the Design-Build Entity as a whole and to each of its Core Organizations and is for identification purposes only. There is no scoring value to this part.

Subpart I.A is the only public record portion of the Project Qualification Questionnaire.

PART II: ESSENTIAL REQUIREMENTS FOR THE DESIGN-BUILD ENTITY AS A WHOLE

Part II applies to the Design-Build Entity as a whole and consists of a series of pass/fail qualification questions. All questions must be answered correctly, or the Design-Build Entity may be disqualified with no consideration given to the remainder of the Questionnaire.

PART III: SCORED QUESTIONS FOR INDIVIDUAL MEMBERS OF THE DESIGN-BUILD ENTITY AND CORE ORGANIZATIONS Subpart III.A: Scored Questions for the General Contractor Subpart III.A applies to the General Contractor. It consists of a series of questions that must be answered, each of which has an established numerical score for potential answers (as shown in the sample Scoring Worksheet provided herein). The total score attained establishes the rating for the Design-Build Entity’s General Contractor (which may be the DBE itself).

There is a maximum possible score of 74 in this subpart.

Subpart III.B: Scored Questions for the Architect Subpart III.B applies to the Architect. It consists of a series of questions that must be answered, each of which has an established numerical score for potential answers (as shown in the sample Scoring Worksheet provided herein). The total score attained establishes the rating for the Design-Build Entity’s Architect.

There is a maximum possible score of 29 for this subpart.

Subpart III.C: Scored Questions for the Sub-Consultants Subpart III.C applies to each required core design-build team Sub-Consultant. It consists of a series of questions that must be answered for each core Sub-Consultant, each of which has an established numerical score for potential answers (as shown in the sample Scoring Worksheet provided herein). The total score attained establishes the rating for each required core Sub-Consultant.

There is a maximum possible score of 29 for each (87 total) Sub-Consultant in this subpart.

PART IV: CONSTRUCTION EXPERIENCE

To help the County assess to what extent the Design-Build Entity and its members have completed, or have demonstrated the experience, competency, capability, and capacity to complete projects of similar size, scope, or complexity to the Project, Part IV requires the Design-Build Entity to submit information on recently completed comparable projects designed and constructed by the DBE, its General Contractor, and its Architect.

This part includes pass/fail criteria, plus comparable project information for the projects submitted. The aggregate score for comparable projects is 50 total points for the general contractor and 50 total points for the Architect.

In addition, the County will select four (4) projects, two (2) Design-Build general contractors and two (2) Design-Build Architects, from the total list of reference projects submitted and include the interviews of owner representatives using the scored Reference Interview Questions provided herein. Each “scored” question has a possible value ranging from 1 to 10. The total possible points are 280 for the GC and 280 for the A/E in this section. It is the sole responsibility of the Design-Build Entity to ensure that these reference forms are received by the submission deadline. Failure to timely submit the form, or submitting a form with incomplete or outdated information, will result in the projects not being included for scoring. The names, Project address, email, and telephone numbers of references must be current and verifiable. The County reserves the right to: (1) contact any and all names listed by the submitting entity in connection with any of the projects disclosed in the Qualification Questionnaire; (2) contact any other individuals or organizations that the County determines may have relevant information about the entity’s qualifications or the accuracy of any information provided on the Qualification Questionnaire; or (3) visit any of the projects disclosed in the Qualification Questionnaire.
