SECTION 108.02—LIMITATION OF OPERATIONS of the Specifications is amended to include the following:

No lane closures are allowed on I-81 on the weekend of any Virginia Tech Home Football Game, unless otherwise approved by the Engineer. For any Thursday night Virginia Tech Home Football Game, no lane closures will be allowed on I-81 that Thursday or Friday, unless otherwise approved by the Engineer.

No lane closures are allowed on I-81 on the weekend of Virginia Tech Graduation or Radford University Graduation, unless otherwise approved by the Engineer.

No lane closures are allowed on I-81 from the Wednesday prior to, until the Monday after, Virginia Tech student move in dates and/or Radford University student move in dates.

The Contractor must complete all shoulder trenching and shoulder paving prior to any other bridge superstructure work.

Once the Contractor mills a bridge deck, work must be continuously prosecuted until all superstructure work on that bridge is completed. The Contractor may request that the Engineer allow work to begin on another lane of a bridge prior to completion of the concrete surface color coating, and false-work removal.

Prior to beginning any work at this location, the Contractor shall submit a detailed work plan to the Engineer for review and approval. The work plan shall include complete details of the planned work including; time schedules, manpower requirements, equipment needs for each element, staging areas and sketches as needed. The overlay work plan elements will be for shoulder rehabilitation, false work, deck slab closure, deck patching operations, milling, hydro-milling and placing of latex and asphalt overlays, and incidental items that include concrete superstructure and substructure surface repairs, deck grooving, joint placement, concrete surface color coating, rumble strips and roadway stripping. No work will be allowed to begin until the Department has completed a review of the proposed work plan and provided final approval. The Department will respond to the Contractor’s submission within 10 business days by approving the work plan, approving the work plan with comments/conditions or noting deficiencies in the plan and requiring a resubmission.

Once the Contractor begins concrete substructure surface repairs and concrete superstructure surface repair work on a bridge, work must be continuously prosecuted until all such work on the bridge is completed.

If roadway approaches are not paved prior to opening to traffic, a hot-mix asphalt wedge will be constructed that provided a smooth transition from the milled asphalt surface to the bridge deck overlay.

Once the bridge deck overlay is completed, the Contractor has 48 hours to complete approach paving.

In order to allow for the completion of the bridge deck overlay, the Contractor may close a single lane on NB I-81 for up to 15 continuous hours and SB I-81 for up to 15 continuous hours during the periods designated below. The NB and SB lane closures cannot occur simultaneously. The Contractor is responsible for chipping out abutment and pier joints in accordance with the plans within the 15-hour closure period. Cold joints mid span are not allowed. The Contractor should end a work shifts latex modified concrete overlay at an existing joint. Each bridge will be allowed up to twenty 15-hour lane closures. 15-hour continuous lane closures will only be allowed during the following hours:

North Bound Route I-81 over Peak Creek.

6:00 PM through 9:00 AM

South Bound Route I-81 over Peak Creek 7:00 PM through 10:00 AM

In the event that during the 15-hour lane closures, the allocated time limits are exceeded and the Contractor fails to restore all traffic for any lane of I-81 by the allotted time, a User Fee will be assessed at the rates in the following table and calculated in accordance with example #2. These fees will be deducted from the next monthly progress estimate.

The Contractor may close a single lane on I-81 five days a week, Sunday night through Friday morning, between 8:00 PM and 6:00 AM.

In the event that the allocated time limits are exceeded and the Contractor fails to restore all traffic for any lane of I-81 in by 7:00 AM a User Fee will be assessed. The User Fees for failure to restore all lanes to traffic by the designated time will be assessed at the rates in the following table and calculated in accordance with the following example #1. These fees will be deducted from the next monthly progress estimate.

Should the hours exceed the hours shown in the table for I-81 – Pulaski County (daily) Sunday through Friday mornings (i.e. 7 AM to Noon) to re-open lane(s), the cumulative User Fee’s shall be increased by an additional $3,000.00 per hour, or any fraction there of (see example #2).

I-81 – Pulaski County (daily)

User Fee’s Cumulative Fee’s for failure to remove lane closure and restore traffic by 7:00 AM:

Hours

$100 $100 First Hour or any fraction – 7 to 8 AM

$250 $350 Second Hour or any fraction – 8 to 9 AM

$700 $1,050 Third Hour or any fraction – 9 to 10 AM

$1,700 $2,750 Fourth Hour or any fraction – 10 to 11 AM

$2,400 $5,150 Fifth Hour or any fraction – 11 to Noon

User Fee’s Calculation Examples:

Example #1:

If Lane Closure remains in place until 8:40AM, the resulting fee will be calculated as follows:

7 to 8 AM = $100 (for first hour)

8 to 8:40 AM = 40/60 hours x $250 = $166 (fraction of second hour)

Total User Fee = $100 + $166 = $266

Example #2:

If Lane Closure remains in place for SBL until 12:50 PM, the resulting fee will be calculated as follows:

11 AM – Noon = $5,150 (for first hour)

Noon to 12:50 PM = 50/60 hours x $3,000.00 = $2,500 (fraction of sixth hour)

Total User Fee = $5,150 + $2,500.00 = $7,650

For the purposes of this provision restoration of traffic shall mean the opening of all traffic lanes to traffic including the completion of all construction work, the removal or relocation of all work zone traffic control devices and signs to their approved site as determined by the Engineer, and removal of all workers, materials and equipment from the roadway.

These fees are imposed, not as a penalty, but in order to minimize the impact of lane closures and construction operations on roadway users. The fee amount is based on daily road user costs, which are defined as representing the average daily cost of interference and inconvenience to the road user.

The Contractor waives any defense as to the validity of any fees stated in the Contract, the Contract Documents or these Specifications and assessed by the Department against the Contractor on the grounds that such fees are void as penalties or are not reasonably related to actual damages.

Any liquidated damages assessed in accordance with Section 108.06 of the Specifications will be in addition to the any fees assessed as shown herein.

10-19-23 (SPCN)

PROTECTION OF BAT SPECIES — The work must be accomplished at night. In addition the night work below the bridge or that penetrates through the bridge deck of Federal Structure #14471 can only be conducted during the time frame of one hour after sunset and one hour before sunrise with no activities below the deck being conducted from 10:00 PM to Midnight.

If bats are observed roosting on a structure, the Contractor shall immediately notify the Engineer and suspend work in the immediate vicinity of the bats until authorized to continue.

1-3-22 (SPCN)

SECTION 425—RIGID CONCRETE BRIDGE DECK OVERLAYS of the Specifications is amended as follows:

SECTION 425.03(b) Overlays is amended to include the following:

Tests shall be done one or more days after the overlay is placed and at a time when the lane can be closed to traffic with minimum inconvenience to the public. A test result shall consist of an average of three test locations.

SECTION 425.03(b) Overlays is amended by replacing the last sentence of the third paragraph with the following:

Vehicular traffic shall not be permitted on the bridge until the overlay has attained a minimum compressive strength of 2,500 pounds per square inch, ASTM C39.

10-19-23 (SPCN)

SALEM DISTRICT TRAFFIC QUANTITY — During shoulder trenching and excavation, if selected locations of soft yielding soil or wet areas are encountered, the subgrade shall be excavated an additional

8.0 inches and 8.0 inches of Aggregate Material, No. 1 shall be placed prior to asphalt placement. This work, if necessary, will be measured and paid for in tons of Aggregate Material, No. 1 and cubic yards of Extra Excavation. Removal and disposal of drainage aprons shall be included in the cost of Asphalt Concrete, Type BM-25.0 (T).

9-19-23 (SPCN)

SALEM DISTRICT CONCRETE REMOVAL — In areas where existing concrete is to be removed and replaced by new concrete, the requirements of Section 412 of the Specifications shall apply, except as amended below:

1. Whenever existing reinforcing bars are exposed, concrete shall be removed no less than 1’’ below the bottom of the top mat of reinforcing steel.

2. Existing concrete shall be removed as shown on the plan details or as directed by the Engineer, to horizontal and vertical planes only, and to sound concrete, taking care not to damage any existing reinforcing steel.

3. Within twenty-four hours prior to placing new concrete, exposed reinforcing steel and faces of existing concrete shall be cleaned by abrasive blast cleaning.

4. Immediately prior to placing new concrete, exposed reinforcing steel and faces of existing concrete shall be cleaned of all dust and debris, and faces of existing concrete shall be in a saturated surface dry condition.

5. The perimeter of all surface repair areas shall be sawn one-inch deep in a rectangular pattern.

6. New reinforcing steel shall be furnished and installed as directed by the Engineer.

SALEM DISTRICT ENVIRONMENTAL REQUIREMENTS — The Contractor shall provide appropriate work platforms, scaffolds, under bridge access vehicles, and other equipment that is required to obtain access to areas of work performed under this contract. These may not come in contact with rivers, streams, or other bodies of water unless permitted by Salem District Environmental Division. The Engineer shall be provided access to work areas to determine the extent of repairs and to inspect the completed work. The cost of access equipment and materials shall be included in the price bid for the appropriate items.

The Contractor shall submit to the Engineer a detailed plan for containing construction related material (i.e. shot blasting media, pieces of concrete debris, uncured concrete, etc.) and preventing its entry into jurisdictional bodies, such as streams and wetlands.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($16.20) or 13658

($12.15). Please see the Note at the top of the wage determination for more information.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the

Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses

(29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate

(weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or

""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010

08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
