About this file
This is a Contractor Employee Jury Service Ordinance document issued by San Mateo County, establishing mandatory jury service policy requirements for county contractors. The ordinance applies to all contracts valued at $100,000 or more and requires contractors to maintain written policies providing full-time employees with no less than five days of annual regular pay for actual jury service in San Mateo County. Contractors must certify compliance with this policy at the time of contract proposal submission, and non-compliance may result in bid rejection, contract termination, or disqualification from county contracting for up to five years. The ordinance became effective September 1, 2005, and applies to all contracts awarded or amended on or after that date, with exceptions for contractors under collective bargaining agreements until the next agreement renewal.
The San Mateo County Executive's office is responsible for implementing and enforcing the ordinance, including adopting regulations, receiving employee violation reports, and recommending sanctions to the Board of Supervisors. The Board of Supervisors may grant waivers under specific circumstances, including emergency contract awards, sole-source situations, lack of compliant bidders, grant conflicts, or cooperative purchasing agreements. Contractors may request remedial action after findings of noncompliance. This ordinance requirement directly impacts the Job Order Contract for General Construction (JOC 2601 through JOC 2605) solicitation, meaning all selected general construction contractors must comply with these jury service provisions as a condition of contract award and performance.
