About this file

This is a Justification for Other than Full and Open Competition document for a Federal Bureau of Investigation (FBI) Laboratory Division acquisition of genetic analyzer equipment.

The FBI seeks to procure one Applied Biosystems 3500XL HID Genetic Analyzer with installation kits, plus associated services, under a new firm fixed-price contract. The base period runs from January 30, 2026 to March 31, 2026. Required services include advanced 3500 series genetic analyzer on-site training and shipping and handling. The acquisition is justified under 41 U.S.C. 3304(a)(1) and FAR 6.103-1 as a sole-source procurement based on brand name specification. The FBI determined that Thermo Fisher Scientific/Life Technologies is the only responsible source because it is the sole manufacturer and distributor of the 3500XL Genetic Analyzer and all associated consumables (capillaries, cartridges, chips, polymer, buffers, size standards, and replacement parts). The equipment is the only commercially available 4, 8, and 24 capillary system validated according to SWGDAM guidelines for DNA analysis for human identification. The customized software and dedicated computers are compatible only with Thermo Fisher Scientific/Life Technologies systems. The FBI conducted market research through discussions with laboratory subject matter experts and determined no other instrument is available that provides comparable functionality with the Thermo Fisher reagents and software. The FBI will publish a Sources Sought notice on SAM.gov to allow other vendors to demonstrate capability. The contracting officer will conduct a cost/price analysis under FAR 13.106-3 to determine fair and reasonable pricing prior to award. For subsequent acquisitions, the FBI will continue monitoring industry developments and may require potential alternative sources to undergo compatibility and validation testing.

Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable

The Federal Bureau of Investigation’s efforts made to solicit offers among as many sources as practicable is described below.

Sources Sought Notice via SAM.gov (or otherwise)

The FBI will publicize the notice of intent to award a sole-source contract on the SAM.gov website. This announcement will give an opportunity for other vendors to demonstrate their ability to meet the FBI's needs through a submission of technical capabilities and cost information.

Anticipated dollar value of the proposed acquisition and determination by the contracting officer that the anticipated cost to the government will be fair and reasonable

The Federal Bureau of Investigation's methodology which supports the determination of fair and reasonable cost to the Government is provided below.

Cost/Price Analysis

Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.

Description of the market research conducted and the results

The Federal Bureau of Investigation’s description of the market research technique(s) it employed to determine the necessity of restricted (other than full and open) competition is provided below.

Contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirements.

Discussions with the Lab SME regarding the instrument usage. No other instrument is available that will work with the Thermo Fisher Scientific/Life Technologies reagents, consumables, and software that significantly improves the ease of use and application efficiencies. The 3500xL has a throughput of 300 samples a day with an injection time of 30 minutes for 24 capillaries; additionally, the reagents are pre-packaged which increases efficiency by saving hours of reagent preparation work. Market research determined that the Genetic Analyzers and the associated software contain a dedicated computer that is customized to operate the system and is compatible with the manufacturer’s software. The computers attached to these systems are imaged specifically for Thermo Fisher Scientific/Life Technologies and are not available from another source. The market research also concluded the Thermo Fisher Scientific/Life Technologies Genetic Analyzers are the only commercially available 4, 8, and 24 capillary systems that have been validated according to SWGDAM guidelines to analyze DNA samples for the purpose of Human Identification. In addition, Thermo Fisher Scientific/Life Technologies is the sole manufacturer/distributor of the validated system consumables including capillaries, cartridges, chips, polymer, buffers, size standards, and replacement parts. Due to the technical nature of these products and because they are sole manufacturer of these highly unique instruments, the recommended source for the purchase is Thermo Fisher Scientific/Life Technologies Corporation.

Other facts supporting the use of restricted (other than full and open) competition

The Federal Bureau of Investigation’s description of additional facts which support the use of restricted (other than full and open) competition is provided below.

If FDDU does not acquire the 3500xL Genetic Analyzers for Human Identification, it will cost the Laboratory Division time and money. Without these products, the FDDU will use more reagents and have increased downtime, which will negatively affect the unit’s ability to process the high quantity of samples being submitted to the laboratory.
