About this file

This is a Justification for Other than Full and Open Competition document from the Federal Bureau of Investigation's Laboratory Division for requisition number SHOP-PR-26-000557. The FBI seeks a general repair and maintenance service contract for a Q Exactive Mass Spectrometer through a single-source award to Thermo Electron North America LLC under the authority of 41 U.S.C. 3304(a)(1) and FAR 6.103-1 (Only One Responsible Source - Brand Name Specification). The contract is structured as a new Firm Fixed Price agreement with a base period from April 1, 2026 to March 31, 2027, and four optional periods extending through March 31, 2031. The primary deliverable is a Service Plan for the Q Exactive Mass Spectrometer in the quantity of one each per period, with pricing to be determined (listed as undefined in the document).

The FBI's justification for restricting competition centers on the proprietary nature of the Q Exactive Mass Spectrometer, manufactured exclusively by Thermo Electron North America LLC. The agency asserts that using any other vendor would void the instrument's warranty and that only factory-certified service engineers from the manufacturer can perform the required annual maintenance, troubleshooting, and component replacement with access to factory-certified parts. The FBI conducted market research via Google searches and GSA checks, finding no alternative vendors capable of servicing this specific equipment. The document notes that the equipment has been validated, integrated into technical procedures, and staff are already trained on it. The contract includes provisions for Other Direct Costs (ODCs) that require advance written approval from the FBI Contracting Officer, with detailed invoicing requirements for any such purchases. No sources expressed interest in the acquisition, as the requirement was not publicly synopsized.

Statutory authority permitting restricted (other than full and open) competition

The Federal Bureau of Investigation’s selected statutory authority which permits restricted (other than full and open) competition for this requirement is listed below.

41 U.S.C. 3304(a)(1), FAR 6.103-1 — Only One Responsible Source (Brand Name Specification)

41 U.S.C. 3304(a)(1), FAR 6.103-1 — Only One Responsible Source (Brand Name Specification)

Unique qualification(s) application:

There is a reasonable basis to conclude that the agency’s minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities.

Unique qualification(s) details:

Specific characteristics of the specialized service with Thermo Electron North America LLC to provide maintenance on their Q Exactive Mass Spectrometer. Only this suggested source can furnish the maintenance due to the fact that the Q Exactive Mass Spectrometer is proprietary to Thermo Electron North America LLC and using another vendor will void the warranty so the service contract must remain with Thermo Electron. A certified service engineer from the manufacturer must perform annual service on the instrument. These contracts are required to maintain timely processing of evidence by the EU Chemistry discipline. Thermo Electron North America LLC service engineers are uniquely qualified to troubleshoot and resolve problems experienced by the instrument under the contract. Additionally, the contract services assist in teaching EU staff about identifying such problems in the future to expedite repairs. Thermo Electron North America LLC service engineers have access to the necessary consumables and instrument parts to replace any malfunction component on an instrument in a timely fashion. Factory certified parts are also included in this services agreement which in some cases can exceed the cost of the service contract therefore it is financially beneficial for the US Government.

Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable

The Federal Bureau of Investigation’s efforts made to solicit offers among as many sources as practicable is described below.

Sources Sought Notice via SAM.gov (or otherwise) can utilize SAM.gov

Anticipated dollar value of the proposed acquisition and determination by the contracting officer that the anticipated cost to the government will be fair and reasonable

The Federal Bureau of Investigation's methodology which supports the determination of fair and reasonable cost to the Government is provided below.

Market Research (including an Independent Government Cost Estimate)

Google searches on the internet have produce no similar forensic instruments that is capable to provide the technical procedures that are needed for chemist’s analysis. Companies such as ZefSci and Dalton Bioanalytics have services for mass spectrometers, but they cannot offer services for the Thermo Electron Q Exactive Mass Spectrometer due to the fact that the prodict is proprietary and the maintenance on the Q Exactive Mass Spectrometer can only be completed by a service engineer from Thermo Electron North America LLC. Additionally, replacement parts must be from Thermo Electron North America LLC to void any warranty on the instrument.

End users have also checked on GSA with zero results pertaining to services and parts for the Q Exactive Mass Spectrometer

The Q Exactive Mass Spectrometer from Thermo Electron North America LLC has been utilized, validated, written into technical procedures, and the chemists already being trained and qualified on the instrumentation from Thermo Electron North America LLC. This is a proprietary product that is patented and has only one manufacturer.

Thusly, it is recommended that the Q Exactive Mass Spectrometer Service contract be award to Thermo Electron for 1 year of service.

Description of the market research conducted and the results

The Federal Bureau of Investigation’s description of the market research technique(s) it employed to determine the necessity of restricted (other than full and open) competition is provided below.

Reviewing the results of recent market research undertaken to meet similar or identical requirements.

The Unit is often reviewing market research to see if other companies can compete.

Other facts supporting the use of restricted (other than full and open) competition

The Federal Bureau of Investigation’s description of additional facts which support the use of restricted (other than full and open) competition is provided below.

The Thermo Electron Q Exactive Mass Spectrometer is proprietary to Thermo Electron North America LLC which exclusion of other brands, are required because there is only a singular manufacturer for not only this instrument, but this type of mass spectrometer. Therefore, only trained personal from Thermo Electron North American can provide maintenance on these instruments.
