U.S. Department of Justice Washington, DC 20530
Limited Sources Justification
1. Identification of the agency and the contracting activity.
This justification is prepared by the United States Department of Justice (Department or DOJ) in accordance with Federal Acquisition Regulation (FAR) 8.405-6. The requiring organization is the Justice Management Division, Security and Emergency Planning Staff (SEPS). The contracting activity is the Justice Management Division, Procurement Services Staff (PSS).
2. Nature and/or description of the action being approved.
The Department intends to modify Task Order DJJ12-F-2245 for guard services for DOJ facilities in the Washington, DC metropolitan area to extend the term of the order for a period of up to nine (9) months. The modification, which will extend the task order expiration date from March 31, 2017 to September 30, 2017, and include an option period ofthree (3) months, will ensure continuity of mission critical services until the follow-on order is awarded and performance transitioned.
Task Order DJJ12-F-2245 was awarded to Centerra Group, LLC on September 28, 2011 using competitive procedures under the General Services Administration Federal Supply Schedule (FSS) program. The order was originally valued at $137.1 million and was scheduled to expire on September 30, 2016.
At that time, under the auspices of the option to extend services clause, the order was extended for six months to March 31, 2017 to afford the DOJ additional time to conduct the follow-on procurement. However, the Government's acquisition team responsible for conducting the planned competitive procurement action was unable to make any substantive progress during this time due to resources being diverted to other mission critical functions, including activities leading up to and including the 2016 presidential election and subsequent transition to the new administration.
The follow-on procurement is well underway. Market research began in January with the posting of a Request for Information to FedBizOpps and the responses have been reviewed. The solicitation is being finalized with a planned issue date of April ist to vendors under FSS 84 Total Solutions for Law Enforcement, Security, Facilities Management, Fire, Rescue, Clothing, Marine Craft and Emergency/Disaster Response.
Award is projected for September 2017.

3. Description of the supplies or services required to meet the agency's needs, including the estimated value.
Under the current task order the Contractor provides protective contract guard services and ancillary support services for 13 DOJ owned, leased, and/or occupied facilities or designated venues in the Washington, DC metropolitan area. The contractor furnishes 275
Protective Service Officers (PSOs) who are granted limited special deputation authority from the U.S. Marshals Service for the purpose of providing security for DOJ facilities.
Within the District of Columbia, PSOs may make warrantless arrests in the same circumstances as the Metropolitan Police, based on the authority granted in the D.C. code.
This arrest authority applies on both federal and non-federal property. Due to the sensitive nature and location of the work, the Contractor is required to have and maintain a Top Secret facility clearance.
Anticipated expenditures during the extension, including the three-month option period (if exercised), will be approximately $21 million.
4. Authority and supporting rationale including, if applicable, demonstration of the proposed contractor's unique qualifications to provide the required supply or service.
The services obtained through this task order support mission critical operations in a number of DOJ components for which continuity is essential. The acquisition for the follow-on order is being conducted by PSS using competitive procedures under the GSA FSS and will result in the award of a single task order with a 6-year performance period (including all options) and an aggregate estimated value of $150 million. The follow-on order is anticipated to be awarded in September 2017. Although the new order may be awarded just prior to the expiration of the current task order, even under the best of circumstances transition to the new order will require 60 days. The Department must also account for unforeseen events, such as a protest, that could lengthen the transition period.
Given the need for continuity of these mission critical services and the transition to the new, competitively awarded task order, the Department is limiting consideration to Centerra Group, LLC as authorized by FAR 8.405-G(a)(l)(i)(C), in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.
5. Determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The General Services Administration has already determined that the prices under Centerra Group, LLC Contract No. GS07-F-5548P are fair and reasonable. To determine best value, prices proposed for the extension period will be compared with prior prices paid under the competitively awarded task order and similar services available from other GSA FSS vendors.

6. Description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
As explained in section 4 above, the Department is conducting the recompetition for the follow-on order and expects to award the order in September 2017. The Department has determined that further market research in support of the extension period would not yield meaningful additional information. For these reasons, the Government does not intend to compete the extension period.
7. Any other facts supporting the justification.
Initial planning for the follow-on procurement action began over a year ago and the planned schedule was expected to meet requirements. However, SEPS was subsequently selected as a major contributor to security for the January 2017 presidential inauguration which became SEPS top priority. The inauguration responsibilities severely restricted the ability of key SEPS personnel to devote time to this procurement and delayed the start of any substantive work until January 2017. In addition, SEPS continues to experience key personnel shortages which have the potential to impact the timeline. The revised schedule takes the personnel issue into account to minimize the need for future adjustments. This extension to the current task order will ensure that the Government has sufficient time to conduct a meaningful competition for the follow-on award and allow for an orderly transition.
8. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
No sources have expressed interest in the extension period.
