This document is a justification for a sole source award of a contract for possession transfer services of AN/UDM-1B irradiators. The Naval Surface Warfare Center Carderock Division requires possession transfer services from the original equipment manufacturer, JL Shepherd and Associates, for 12 AN/UDM-1B irradiators in support of the Radiation Detection, Indication and Computation Program. As the OEM and sole possessor of design patents, JL Shepherd and Associates is deemed the most qualified source to perform the transfers in accordance with regulatory requirements. The proposed one-year contract includes three one-year options and has an estimated total value of approximately . The Department of the Navy Naval Sea Systems Command will issue the solicitation.

DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER IN REPLY REFER TO:

J&A Number: 21-CCR-024 Code:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

Naval Surface Warfare Center Carderock Division (NSWCCD),

2. Description of the Action Being Approved

This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a one year contract with three one-year option, firm fixed price contract to be awarded to JL Shepherd and Associates (hereinafter referred to as JLS).

3. Description of Supplies/Services

The Radiation Detection, Indication and Computation (RADIAC) Program, through NSWCCD Radiation Detection Technology Branch (RDTB), needs possession transfer services from the Original Equipment Manufacturer each AN/UDM-1B (Model 81-12) irradiators.

The total estimated dollar value of the proposed new contract action is . The following is a breakdown of the estimated funding amounts for this proposed contract action:

Fund Type FY21 FY22 FY23 FY24 Total ($K)

O&MN

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (FAR 6.302-1).

5. Rationale Justifying Use of Cited Statutory Authority

The possession transfers are available from commercial sources other than JLS. However, JLS is the OEM of the irradiators and sole possessor of design patents that ensure compatibility.

The Radiological Affairs Support Program Manual, NAVSEA S0420-AA-RAD-010 Rev2A, justifies use of the OEM in section 2.25.1.1 Disposal of Radioactive Material:

DET RASO, commands possessing radioactive material and/or radioactive sources that are no longer required should attempt to transfer the radioactive material and/or radioactive sources to the manufacturer or another

Due to the above referenced requirement for disposal (possession transfer) of radioactive material, a sole source award to JLS as the OEM is necessary. Moreover, an alternative commercial source would be able to meet the disposal (possession transfer) requirement only by subcontracting to JLS as the OEM.

6. Description of Efforts Made to Solicit Offers from as Many Sources as Practicable

The proposed contract will be synopsized via posting on the System for Award Management (SAM) website in accordance with FAR 5.2 as a combined synopsis/solicitation for the acquisition of commercial services, Market Survey: JLS is the OEM and sole possessor of design patents of the Irradiators and found to be the most certified to perform the possession transfers IAW with NAVSEA S0420-AA-RAD-010 Rev2A. Moreover, an alternative commercial source would be able to meet the disposal (possession transfer) requirement only by subcontracting to JLS as the OEM. Therefore, no market research was conducted to search for alternative commercial sources.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine whether the cost to the Government for the commercial services covered by this J&A will be fair and reasonable in accordance with FAR 6.303-2(b)(7).

8. Actions to Remove Barriers to Competition

JLS is the OEM and is best suited to perform the possession transfers. In addition, as stated in paragraph 6, an alternative commercial source would be able to meet the disposal (possession transfer) requirement only by subcontracting to JLS as the OEM.
