About this file

This is a Sole Source Justification document for a restricted competition procurement submitted by the Department of Veterans Affairs, Network Contract Office 21 on behalf of the Fresno VA Medical Center (VAMC).

The procurement is a one-year firm-fixed price purchase order for blood and blood products with on-call delivery, effective June 1, 2026 through May 31, 2027. Competition is restricted under RFO FAR 12.201-1 Simplified Procedures for Certain Commercial Items, citing 41 U.S.C. § 1901 as statutory authority. The justification establishes that only one responsible source exists capable of satisfying the agency's requirements. Only the Central California Blood Center (NHLLKL94DAJ7, Large Business) is FDA-registered to store and distribute blood and blood products to the Fresno VAMC within the required two-hour STAT delivery timeframe. The contracting officer determined anticipated unit rates are fair and reasonable based on comparison to previous blood product contracts. Market research identified ten FDA-registered blood establishments in Fresno, but the VA itself represents one result, three are inactive, and three others (BioLife Plasma Services L.P., Biomat USA, Inc., and Octapharma Plasma, Inc.) collect plasma only and lack authorization to store and distribute to others. Although the Small Business Administration search identified 72 potential SDVOSBs and VOSBs, FDA registration requirements and the short turnaround delivery obligation limit the requirement to one capable vendor. The Non-Manufacturer Rule does not apply, and the "rule of two" cannot be met for any set-aside. The justification has been certified by both the Contracting Officer and one level above the Contracting Officer as meeting requirements for other than full and open competition.
