About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the procurement of services to migrate two Fan Coil Units in West Wing Room 106 to the existing building automation system at the White House.

The General Services Administration (GSA) requires these services due to the proprietary nature of the Fan Coil Units and associated control system, which can only be provided by the original equipment manufacturer, Schneider Electric Buildings Critical Systems, Inc. The procurement is sole-sourced under the statutory authority of FAR 6.302-1 for only one responsible source, with an estimated cost of $17,980. The work must be completed by August 1, 2024 to meet the timeline required by the United States Secret Service. The Contracting Officer has determined the anticipated price is fair and reasonable based on an Independent Government Estimate. No other sources expressed interest in this requirement during market research.

GENERAL SERVICES ADMINISTRATION

National Capital Region Office of Acquisitions

JUSTIFICATION AND APPROVAL

1. Contracting Agency and Activity (FAR 6.303-2(b)(1)) The General Services Administration, Public Building Service, National Capital Region, Office of Acquisitions, Special Programs Division, White House Branch plans to contract by means other than full and open competition, utilizing Sole Source Justification.

2. Nature of Action Being Approved (FAR 6.303-2(b)(2)) The justification and approval is for contracting without providing for full and open competition as prescribed by FAR 6.302. The determination has been made that there is Only one responsible source and no other supplies or services will satisfy agency requirements.

4. Identification of statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)) The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Demonstration of the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)) is uniquely qualified to provide these services to the White House Service Center based upon the following:

a. The Fan Coil Units and the are proprietary systems by and to maintain the warranty for this equipment and control system, all labor and materials must be provided by

b. In the original procurement for the installation of these Fan Coil Units and Control System and other items, the Contracting Officer approved the usage of proprietary equipment and software to meet the needs of the General Services Administration.

c. This requirement was not included in the scope of work for the original project and the need to tie the Fan Coil Units into the Control System is a unique and new requirement.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies (FAR 6.303-2(b)(6))

The White House Acquisition Team and the White House Service Center did not publicize the proposed contract action due to the exception provided in FAR 5.202(a)(2) the proposed contract action was made under the conditions described in 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in 5.203. The project start date must be 8/1/2024 in order to successfully complete this project within the timeframe allotted by the United States Secret Service. Due to the sensitive location of the Fan Coil Units and access point to the control system, there is only a few allotted times in August 2024 for this work to be completed. Therefore, posting notice of the proposed contract action for 10 days, allowing sufficient time for solicitation, and proposal evaluation would not provide a contract award date prior to 8/1/2024. This would prevent the Government from successfully completing the work and continue to cause disruptions as not being connected to the Control System requires maintenance workers to manually change the settings at the equipment access point.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7))

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on an Independent Government Estimate. Prior to award of the proposed contract/modification/order, cost or price information shall be obtained from the contractor and a price/cost analysis will be performed and documented to sufficiently determine that the cost to the Government of the proposed acquisition will be fair and reasonable.

8. Description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8))

Market research was conducted by the White House Service Center and the White House Acquisition Team to identify available sources and to evaluate the availability of the marketplace to meet the requirement as follows: Based on the results of market research, the government determined that a limited number of vendors were/are available but none possessed the capability to successfully access the proprietary system and equipment to meet the needs of the agency.

9. Other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)) has familiarity with the requirement, building layout and White House Complex security requirements. All the building automation systems on the White House complex are from and are proprietary. The Government is confident that the award of an order to this contractor will result in the timely execution of this work.
