DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval For
Exception to the Fair Opportunity
Acquisition Plan Action ID: 36C256-20-AP-3689
1. Contracting Activity:
Department of Veterans Affairs, Veteran’s Health Administration, Veteran’s Integrated Systems Network 16, Network Contracting Office 16, Services Team B, Michael E. DeBakey Veterans Affairs Medical Center (MEDVAMC). The requisition number is 580-21-1-255-0002.
2. Description of Action:
The proposed sole source Task Order against National Acquisition Center (NAC) contract number VA797H-17-D-0022 is for a 12-month firm-fixed price effort with two 12-month option periods exercisable at the discretion of the Government for remote monitoring and preventative maintenance with Philips North America LLC. The base period will run from October 29, 2020 through October 28, 2021. Option period one will run from October 29, 2021 through October 28, 2022. Option period two will run from October 29, 2022 through October 28, 2023. Philips North America LLC, hereafter referred to as Philips, is located at 22100 Bothell Everett Highway in Bothell, Washington 89021-8431.
3. Description of Supplies or Services:
The proposed action is to provide all firmware, software, installation, parts, labor, calibration, remote monitoring and preventive maintenance inspections per the Original Equipment Manufacturer (OEM) recommendations and guidelines to fulfill this requirement. The contractor shall provide calibration and preventive maintenance services by OEM authorized service providers of the equipment listed in the attached equipment list. Worn or defective parts shall be replaced when necessary, as per manufacturer’s specifications. Service also includes all necessary intervening service calls required to replace any worn or defective part needed due to equipment failure. The total estimated value of the proposed action is $9,182,249.06, which includes all option periods.
4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505 Subpart 16.505(b)(2)(i)(B), Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
5. Rationale Supporting Use of Authority Cited Above:
Philips is the only contractor capable of providing preventative maintenance to continue full operation uptime at the MEDVAMC. Philips is currently approved to connect to the MEDVAMC owned Philips imaging equipment through a national business associate agreement. No other company is authorized to connect to these devices remotely. These services require remote monitoring to maintain equipment uptime.
