About this file

This is a Limited Sources Justification (LSJ) document for a modification to task order 70US0920F2GSA0100 issued by the Department of Homeland Security (DHS), U.S. Secret Service (USSS) Procurement Division. The modification seeks to add two Human Resources Classification Specialists and eight Staffing and Replacement Specialists to support three HUM Divisions: Classification and Position Management Division, Talent Management Division, and Law Enforcement Acquisition Division.

The justification supports sole-sourcing to incumbent contractor FYI, Inc. of Silver Spring, MD, citing them as the only capable source due to immediate increased demand related to upcoming National Security Special Events including the Presidential Inauguration. The original task order was awarded on August 12, 2020 with a 12-month base period and four 12-month options, running through August 30, 2025. The modification adds 3,840 hours for Classification Specialists and 15,360 hours for Staffing Specialists under Option Year 4. The agency plans to develop a new competitive solicitation using the HCaTs multiple award contract vehicle for future requirements. The justification notes that failing to maintain continuity with the current vendor would jeopardize USSS operations and its "zero-fail" mission.

3. Description of Supplies/Services.

The USSS Office of Human Resource (HUM) has a task order for Human Resources Staffing Specialists that was awarded on August 12, 2020, with a 12-month base period and four (4) 12-month option periods under GSA schedule GS02F0009U/70US0920F2GSA0100. The task order was awarded to FYI, Inc. 8484 Georgia Avenue, Suite 220, Silver Spring, MD 20910. The period of performance is August 31, 2020 to August 30, 2025. This requirement was competed and seven (7) proposals were received. This task order is a firm fixed-price contract. The base period obligated amount was $ with a total contract value of $.

The purpose of the task order is to provide HR Specialists (Staffing). HUM’s staffing and classification branches perform and provide comprehensive support for Federal competitive and excepted service recruitment and staffing, and perform strategic consulting related to

LSJ No: FY24-0059 Page 2 of 4 qualification requirements, recruitment sources and applicable automation tools (automated staffing system) and timeframes.

4. Authority and supporting rationale.

This acquisition is conducted under the authority of Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

Pursuant to FAR 8.405-6(a), the circumstance that justifies limiting sources to fewer than those required by FAR 8.405-1 and 8.405-2 is:

FAR 8.405-6 (a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Rationale:

Without the required specialists support provided by the vendor, the aforementioned services become “non-existent” and would significantly jeopardize USSS operations. Due to immediate increased demand and operational cadence of human capital initiatives and strategic objectives to meet agency hiring goals, staffing and classification operations require additional personnel to assist with ongoing comprehensive support to perform relevant processes for Federal classification, competitive and excepted service recruitments, staffing, and strategic consulting. The acute need is based on multiple factors including upcoming National Security Special Events (NSSE) such as the Presidential Inauguration and the recently designated Counting and Certification of Electoral Votes. To satisfy this requirement, supplemental contractor support will be included under the following labor category positions: The USSS requires an additional 10 contractor staff (Classification – 2 and Staffing and Replacement Specialists – 8). The incumbent vendor is the only logical source for the proposed requirement. An award to any other source would result in an unacceptable delays and/or interruption in fulfilling this requirement that would negatively impact the USSS mission. Without the required specialists support provided by the vendor, the aforementioned services become “non-existent” and would significantly jeopardize USSS operations.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The Contracting Officer anticipates the proposed price will be consistent with the General Services Administration (GSA) schedule pricing held by FYI, Inc. In addition, historical pricing information is available for all services to be provided, which are the basis for the independent government cost estimate. The contracting officer has determined that continuing services for the additional resources for task order 70US0920F2GSA0100 will be fair and reasonable per their GSA schedule and represents the best value and will result in the lowest overall cost for award at this time. GSA has already negotiated fair and reasonable pricing rates. Discounts to FYI, Inc. GSA schedule rates were requested.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

This is a modification to the current task order. Market research has been conducted at the time of the original award. A thorough search of GSA e-library was conducted to ensure that FYI, Inc. still has a valid GSA Schedule since this requirement is a continuation of services from the original vendor.

Currently, no other vendor can fulfill the human resources staffing requirement. The scheduled risk for this procurement is not having this contract awarded in time which will impact the USSS “zero-fail” mission.

7. Any other facts supporting the limited-sources justification.

There are no additional facts at this time.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies or services is made.

USSS is currently in the development of a solicitation, evaluation of proposals, and awarding a new multiple-year contract for the required services using FAR Subpart 16.505(b) Fair Opportunity. The procurement will be solicited to all vendors holding a HCaTs multiple award contract.

9. USSS intends to publish a notice in accordance with 5.301; and post the justification-on SAM.gov pursuant to FAR 8.405-6(a)(2)(i).
