NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

KENNEDY SPACE CENTER (KSC), FLORIDA

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

FOR SAFANDARLEY 80 TON ULTRA PRESS BRAKE

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a justification for other than full and open competition prepared by NASA and the contracting activity is KSC.

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract with Capital Machine Technologies for the SafanDarley 80 Ton Ultra Press Brake, which is an electric press brake with a full electric drive. The contractor shall supply KSC with the press brake and all the services necessary to operate and maintain the brake. The contractor shall also provide initial and recurrent training for contractors operating or performing work on the brake. To ensure the highest levels of safety and to preserve residual value to the Government, all work performed by this contract shall be with SafanDarley certified parts, procedures, and personnel.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):

Description SafanDarley 80 Ton Ultra Press Brake CNC Controlled Laser Line Project Wila New Standard Tooling Package SigmaBEND /AP Bend Simulator (1st Seat) SigmaBEND /AP Simulator Batch and Remote (1st Seat) SigmaBEND 8-hour Web Training SigmaBEND / AP Initial Maintenance (1st Year Support Included)

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c)(1) is that NASA KSC Prototype Laboratory requires the SafanDarley 80 Ton Ultra Press Brake in order to maintain the capabilities for continuity of service, in a timely and safe manner, in support of current and future missions as defined by Center and Program requirements. The SafanDarley 80 Ton Ultra Press Brake is the only know electronic press brake which meets the government’s requirements for tonnage, dimensions, and safety features.

An attempt was made to locate a supplier via the GSA Advantage Catalog at the following link (https://www.gsaadvantage.gov/advantage/catalog/product_detail.do?gsin=11000020822070).

Email correspondence followed with the sole GSA vendor listed, Equipment Resource Center, Inc. The vendor stated that they are no longer a distributor for this product, and it was in the process of being removed from their GSA Schedule.

The SafanDarley website showed that Capital Machine Technologies was the distributor of products for the state of Florida. The SafanDarley North American division was contacted and the president, Karl Fritchen, confirmed via email that Capital Machine Technologies is their sole distributor for the southeastern United States including Florida. The company provided us a scanned copy of the distributor agreement between SafanDarley B.V. and Capital Machine Technologies.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notice to the Government Point of Entry Web site, (beta.sam.gov), will be published in accordance with FAR Subpart 5.2. The posting will inform potential sources of NASA’s intent to award to Capital Machine Technologies, as a sole source; only one responsible source and no other supplies or services will satisfy agency requirements.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The

Contractor shall be required to submit a proposal to be evaluated by the Government. Prior to issuance of any contract award, the Contracting Officer will conduct a proposal analysis, to include a price and cost analysis, where applicable, to sufficiently determine the contract action is fair and reasonable to meet the Government’s needs. Reasonableness of proposed price will be established in accordance with FAR 15.404-1(b)(2)(ii), comparison of proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items. This method may be used for commercial items, including those “of a type” or requiring minor modifications.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

Market research was conducted between April 2019 and March 2020 to locate a replacement press brake for the NASA Prototype Lab. The current press brake is a twenty-two year old 100 tonnage hydraulic brake which is not compliant with OSHA safety standard 1910.212 “General Machine Guarding”.

Online research was conducted to locate press brakes that had a minimum of 80 tonnage pressure and was compliant with OSHA safety standard 1910.212. The required brake footprint size is not to exceed 139 inches (3530 millimeters) in width and 70 inches (1775

mm) in length, and have a height not greater than 99 inches (2510 mm). It was determined that three press brake manufacturers had potential products that would meet these requirements. Hydraulic and electronic press brake literature and quotes were requested from Amada America Inc., Trumpf Inc., and SafanDarley B.V.

The team reviewed the literature to determine what characteristics differentiated the press brakes. The below is a summary of the review findings.

Traditional press brakes are designed with a “C-Frame” which consists of two hydraulic arms on each side of the upper punch die. When bending thicker material the center of the top punch can “crown” the part being that is being bent. The part would resemble a hill after bending instead of a straight “L” shaped part. Another form of deflection with a traditional hydraulic press brake is when bending high tonnage materials such as thick steel or stainless steel, the dies will actually deflect outward rather than applying all of their force downward.

Electronic press brakes are designed with an “O-Frame” instead, which eradicates the issues associated with hydraulic press brakes. The electronic brake has a belt and pulley drive system to provide a consistent distribution of force across the entire length of the machine which eliminates crowning and deformed parts. Electronic brakes also use 50% less energy than hydraulic brakes.

The team decided to proceed with researching an “all-electric” press brake due to its uniform die pressure, elimination of crowning, and 50% energy use reduction. Amada and SafanDarley offered electronic press brakes, while Trumpf offered only hydraulic press brakes. The brakes reviewed were the Amada EG Series and the SafanDarley E-Brake series. The safety and other features are listed below.

Safety Light Curtain Feature:

The safety light curtain feature is important because bending small parts is where the danger is the highest of hand and finger injury to machine operator.

Amada offers a Safety Light Curtain, but their feature will not work with small parts and has to be turned off during these operations. When trying to bend a small part, this safety feature must be turned off in order to operate a foot pedal and apply pressure with one’s hand in the danger zone

The SafanDarley Integrated Safety Light Curtain allows for operator programming which uses the safety feature as a signal for the press brake to cycle. The feature enables the operator to program the software to recognize when one’s hand is safely away from the danger zone, at which time the machine would cycle to bend the small parts. In case of a power failure during cycling operations, the SafanDarley also has an automatic spring return system which forces the top ram to always move upward in the event of a failure rather than continuing the downward force.

Other Features Include:

Minimum speed change point is 1mm (0.039”) versus 6mm (0.250”) which is what other manufacturers offer. This adds efficiency by requiring less time for the pressing process.

Proprietary programming software allowing for OSHA compliant ram and backgauge movement without using the machine foot pedal.

The E-Bend S feature measures the thickness of the material and automatically compensates for it so as to provide an accurate bend which also eliminates waste when producing prototype parts.

The maximum stroke length is 12 inches which provides more capability and a wider range of capacity than what is offered by other manufacturers.

Based on the market research results, it was determined that only the SafanDarley 80 Ton Ultra Press Brake met the government’s requirements for tonnage, dimensions, and safety features.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

None.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

In accordance with FAR 5.203(a)(2), the Contracting Officer may use the combined synopsis and solicitation procedures for acquisition of commercial items. Therefore, there are no sources of expressed interest at this time. The proper actions will be taken to record any and/or all sources that show interest in the acquisition.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
