About this file
This document is a Justification for an Exception to Fair Opportunity under FAR 6.302-2(a) for Unusual and Compelling Urgency for Operations and Maintenance Services at the Hatfield and Pioneer Courthouses in Portland, OR.
The General Services Administration (GSA) Northwest/Arctic Region plans to award a modification to IDIQ contract 47PL0224D0001 to TEAM BRCS LLC to continue providing Operations and Maintenance Services at the Hatfield and Pioneer Courthouses from 9/14/2024 through 12/31/2024 with a 7-month option period. The total estimated value is $667,785.96. The justification cites that the current contractor can no longer provide services starting 9/14/2024, and a lapse in services would seriously impact critical court operations. GSA intends to competitively solicit for these services in FY25 under the Facilities Engineering Model (FEM) contract.

Justification for an Exception to Fair Opportunity
FAR 6.302-2 (a) Unusual and compelling urgency
Operations and Maintenance Services: Hatfield and Pioneer Courthouses
1. Contracting Agency and Activity. The General Service Administration, Northwest/Artic Region plans to award a modification to Indefinite Delivery Indefinite Quantity (ID/IQ) 47PL0224D0001 exceeding the simplified acquisition threshold with an exception to the fair opportunity process.
Selected Vendor Name: TEAM BRCS LLC UIE: DTMGMW5LKM31
2. Nature of Action Being Approved:
The Hatfield and Pioneer Courthouses are currently receiving Operations and Maintenance Services under
Blanket Purchase Agreement (BPA) 47PL0220A0002. This action will incorporate the subject locations into IDIQ
47PL0224D0001 starting 09/14/2024 through 12/31/2024 with a 7 month option.
3. Description of Supplies or Services and Estimated Dollar Value: Operations and Maintenance Services for the
Hatfield and Pioneer Courthouses located in Portland, OR. The government estimate is $667,785.96. At the time of the next option period, 01/01/2025, the pricing will be adjusted for the remaining 7-month option period. Currently time does not allow for that option period pricing.
4. Identification of the exception to fair opportunity and the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. FAR 6.302-2 (a) Unusual and compelling urgency
X (A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. The current contractor that was providing services under BPA 47PL0220A0002 is no longer able to provide Operations and Maintenance Services for the subject locations as of 09/14/2024. Failure to have these services in place, the Government would be seriously injured and interrupt multiple agencies critical operations.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
This modification is being awarded at the same monthly price that was awarded under the previous BPA
47PL0220A0002 for these locations. Those prices were found reasonable at the time of the last option year
03/31/2024.
6. Any other facts supporting the justification.
GSA cannot have a lapse in Operations and Maintenance Services for these two critical courthouses. Lapse in services could lead to failures in the facilities systems leading to increased cost and interrupt court and the different tenant agency proceedings.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
This action will be a short-term solution. GSA intends to solicit competitive quotes from small business vendors via GSA E-Buy for the Facilities Engineering Model (FEM) contract to be awarded in FY25. Based upon the market research conducted on GSA eLibrary for this requirement there are an abundant number of contractors available and from a random sampling multiple small businesses are represented within the GSA eLibrary search results. GSA intends to solicit quotes from small businesses on GSA e-Buy for the FEM requirement.
8. The contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
See section 11 below
9. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for an exception to fair
Docusign Envelope ID: C56A322C-14A8-4EC5-8D49-6CC7A877638E opportunity) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.

10. A written determination by the approving official that the selected exception applies to this order.

11. Certifications/Concurrences/Approvals
