About this file

This document is a brand name justification for a GE CareScape B450 Patient Monitoring System. The Eastern Oklahoma Veterans Health Care System requires one GE CareScape B450 system for a new endoscopy suite at the Tulsa Health Care Center in Tulsa, Oklahoma, with delivery and installation between June 1-15, 2021. The justification cites staff training on existing GE equipment at another facility as requiring the same brand for continuity of care. The total estimated cost is $338,586.02. The justification examines market research and applicable authorities, certifies this as a bona fide need, and documents required approvals.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Brand Name)

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The staff that will be stationed and serve at the Tulsa Health Care Center will be trained on the equipment at the Muskogee VA Medical Center. Currently the Muskogee facility uses the GE B450 Patient Monitoring System as it was procured in FY20 on purchase order 36C25920P1109. Since the Muskogee facility is the designated training site for the Tulsa facility, staff will become proficient at operating the GE system as they prepare for the activation of the new site. Upon opening of the facility, staff must be able to operate effectively and efficiently to provide adequate care to veteran patients.

Any system other than the GE B450 for patient monitoring at the new facility would require additional training and create down time at both the Muskogee and Tulsa medical centers. Staff will be used interchangeably between the two locations; therefore, Nursing staff assigned to both locations must be proficient in the use of the monitoring system. Using different systems to monitor patients at the two locations has high potential to cause confusion when interpreting patient information, creating a safety risk for Veterans under care. The use of a different system would require current Muskogee staff to be trained as well as the Tulsa staff, creating reduced effectiveness and cancelled procedures at Muskogee due to limited staffing.

The cost of implementing a different system would also be prohibitive as there would be additional training cost above the actual purchase of the system. The 18 Nurses on staff would be required to attend training on a new system, costing approximately $3,680.00 per day in salary. This cost is not anticipated to be recovered through competition.

PM Part 813.5 SAP for Certain Commercial Items Page 5 of 7

Revision 02 Date: 08/04/2020

Accordingly, the GE B450 Patient Monitoring System is the only product capable of providing the requirements as described in section 3. above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

A Sources Sought was posted to Contracting Opportunities, NASA SEWP, and GSA on 2/12/21 with a response date of 2/17/21. Responses indicated that the required product is not available on NASA SEWP. TrillaMed, LLC (SDVOSB) and Datex-Ohmeda dba GE Healthcare (Large Business) indicated in writing that they are interested in the requirement.

Jaken Medical, Inc. has been used as a source of similar purchases and has B450 components on their GSA schedule. Further research on GSA indicates that Jaken is the only provider of those components on GSA and; therefore, there is not a reasonable expectation of competition through schedule vendors.

FPDS was searched for keyword “CareScape” and refined for purchases by NCO 19. Results found that the required product has been purchased through TrillaMed, LLC (SDVOSB, 36C25920P1100), JPL & Associates (SDVOSB, 36C25918F4442), and Datex-Ohmeda (Large Business, 36C25920F0232).

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

It is anticipated that costs will be considered fair and reasonable based on the expectation of competition during this brand name solicitation on Contracting Opportunities.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Market research conducted and the results include the following:

- Contracting Opportunities sources sought posting on 2/12/21 with a response date of 2/17/21.

- GSA sources sought posting on 2/12/21 with a response date of 2/17/21.

- NASA SEWP sources sought posting on 2/12/21 with a response date of 2/17/21.

- FPDS Searches for Patient Monitoring. Search results were further narrowed to those made from NCO 19.

- The use of market research data used for the most recent award 36C25920P1109. The market research for that procurement is less than 12 months old.

Based on the previous market research conducted, there are SDVOSBs (Alliant Enterprises LLC and Global Engineering & Management Services) capable of supplying the requirement. Current market research also identified an additional SDVOSB (TrillaMed LLC) and a large business (Datex-Ohmeda DBA GE Healthcare) that are capable of fulfilling this brand name requirement.

Although there are two or more SDVOSBs identified that appeared capable of performing the requirement, the nonmanufacturer rule as set forth in 13 CFR 121.406(b)(1)(iv) and FAR 19.505(c)(1)(iv) cannot be satisfied and precludes the use of a set aside for this requirement. There is not a class waiver for the NAICS of 339112. Therefore, it is anticipated that all sources (large and

PM Part 813.5 SAP for Certain Commercial Items Page 6 of 7

Revision 02 Date: 08/04/2020 small businesses) will be solicited for this requirement using competitive procedures though beta.SAM on an unrestricted basis.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

The immediate operation capability of the new activation site in Tulsa, OK requires staff to be fully trained and ready for patient care. In order to ensure this, continuity of training site operations and activation site operations is imperative. Due to the training of staff on an existing GE B450 platform, the same platform must be used at the activation site to ensure that there are no lapses in veteran care upon facility opening.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

TrillaMed, LLC and Datex-Ohmeda dba GE Healthcare submitted interest in writing.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

The circumstances surrounding this acquisition are unique to the need for immediate operating ability for a newly activated care facility. Future acquisitions will not fall under the same need circumstances as open and operating facilities are more able to function while providing transition time for new equipment if it is a different brand than the equipment currently in use.

The Agency intends to pursue future acquisitions based on salient characteristics to encourage competition among multiple manufacturers and items which can be supplied through multiple vendors.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
