VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36244-22-AP-2697

1. Contracting Activity: Department of Veterans Affairs, VISN 04, Pittsburgh VA Medical Center Radiology Department-University Drive, University Dr. C Pittsburgh, PA 15240-1003

PR: 646-22-2-233-0226

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a brand name only justification for a new injection system for computed tomography imaging equipment. The Radiology Division of the Pittsburgh VA Medical Center is requesting the purchase of the following items:

2.1. one (1) Stellant Flex OCS, Medrad Stellant Flex OCS CT Injection System

2.2. one (1) FLEX OCS, Medrad Stellant Flex CT Injection System with OCS

Total estimated contract value is $ .

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Pittsburgh Radiology department currently has a need to upgrade their CT injection systems. Currently we are not using the same technology with contrast injections between our two CT scanners. This upgrade will allow us to use the same protocols on both of our CT scanners thus increasing the diagnostic accuracy of our contrast enhanced exams. The Pittsburgh Radiology Department has used Bayer CT Stellant power injectors for over 15 years. Currently one

(1) of the two (2) injectors has the most up to date software, and just need the hardware to be refreshed. The second injector needs both software and hardware updates.

4. Description of market research conducted and results or statement why it was not conducted:

A search of the marketplace was conducted between 02-04-2022 to 02-28-2022 to determine the acquisition approach for this requirement.

Bayer Healthcare Pharmaceuticals LLC (Original Equipment Manufacturer) (Large Business) is the manufacturer of the Medrad Stellant Flex OCS CT Injection System and Medrad Stellant Flex CT Injection System with OCS needed by the Pittsburgh VA Medical Center Radiology Department. The Contract Specialist (CS) later verified with the OEM for authorized distributors. OEM responded identifying four (4) vendors: 1st American Medical Distributors, Inc. (SDVOSB), ASE Direct, Inc.

(SDVOSB), Americare (SDVOSB), and QB Medical, Inc. (SDVOSB).

Sources Sought synopsis (36C244-22-Q-0387) was posted from 02-05-2022 to 02-11-2021. This effort produced one (1) response: ASE Direct (SDVOSB).

Contacted 1st American Medical Distributors, Inc., QB Medical, Inc., and Americare (SDVOSB) due to past procurement history. 1st American Medical Distributors, Inc. responded with an Authorized Distributor Letter. QB Medical, Inc. and Americare was nonresponsive to this request.

Administration Quick Market Search found zero (0) vendors.

A keyword search in Federal Procurement Data System found three (3) vendors: Bayer Healthcare LLC (Large Business), 1st American Medical Distributors (SDVOSB), and QB Medical, Inc. (SDVOSB).

A keyword search in GSA Advantage, GSA eLibrary, Interagency Contract Directory Portal, VA Supply Chain Medical Catalog, Defense Logistics Agency Troop Support Medical Electronic Catalog found zero (0) vendors.

non-manufacturer rule database found two (2) waivers.

According to the Market Research above, the CS has a reasonable expectation of receiving two (2) responses on a small business set-aside. As a result, the CS anticipates issuing a Small Business aside Brand Name solicitation on SAM.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
