About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document prepared by the Defense Logistics Agency (DLA) Land and Maritime for solicitation SPMYM126Q4120.

The procurement seeks one Tesker Model 320E Thread Rolling Machine (Part Number 320E) to support a shipyard in providing thread rolling capabilities to mirror capabilities at fellow shipyards. The contracting activity is DLA Land and Maritime, and the requirement will be solicited as a brand name, 100% small business set-aside on SAM.gov on or about June 26, 2026. The justification cites 10 U.S.C. 3204(a)(1) as the statutory authority, establishing that the item is available from only one or a limited number of sources. Tesker Manufacturing Corporation has been identified as the sole source supplier, with no CAGE code provided. The estimated contract value has been redacted from the document, and the contract structure will be a single award with firm fixed price provisions procured under FAR Part 12 (Commercial Items) and FAR Subpart 13.5 (Simplified Procedures for Certain Commercial Items).

Market research was conducted through multiple methods, including review of mandatory sources, online search engines, contact with Tesker Manufacturing's sales representative, and publication of a Sources Sought notice on SAM.gov from June 8-12, 2026, which yielded no competing sources. The contracting officer determined the anticipated cost will be fair and reasonable based on comparison with previous purchases and other available pricing data. Evaluation criteria will include technical capability, price, and Supplier Performance Risk System (SPRS) review. The customer was unable to provide installation space restriction requirements. The contracting officer approval threshold applies to this action, which does not exceed $750,000.

[ ] Other. (Explain) .

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Discuss relevant pricing issues, including the basis for determining that the anticipated price/cost will be fair and reasonable. Also include length of contract, quantity, and other contract particulars bearing on the price.

In accordance with FAR 13.106-3(a), the Contracting Officer will make a determination that the proposed price is fair and reasonable based upon comparison of the proposed price with prices found fair and reasonable on previous purchases, as well as other cost, price, and buyer analysis as available. Information from market research, governmental sources, and Producer Price Index Industry (PPI) Data may also be used to help establish price reasonableness when needed. The length of contact will be from when the contract is awarded and accepted until the requested item is delivered to NNSY.

8. Market Research/Efforts to Obtain Competition:

Describe the market research conducted and the results. The extent of market research required for a procurement varies depending on the estimated dollar value, complexity of the item or service and other factors including, the type of item or service, urgency of the requirement and past experience. However, narrow market research (i.e.

only using market surveys; only contacting the approved source or past awardees) is inadequate.

Market research was conducted to determine commerciality. The CS checked the mandatory sources but could not find the item listed. The CS then checked online search engines and contacted the sales rep for Tesker Manufacturing, as well as visiting the website. The sales rep for Tesker Manufacturing advised the product is commercial and the company sells to the general public and distributors.

A sources sought was posted to Sam.gov 06/08/2026 and closed 06/12/2026. The sources sought yielded no results within that timeframe.

Based on the information above and outlined herein; there is a reasonable expectation that small business concerns would have the capability or resources available to support this requirement.

The contract specialist therefore recommends this requirement be solicited as BRAND NAME, 100% small business set-aside. on Sam.gov. This will be solicited as Other than Full and Open Competition and evaluation criteria will include, technical capability of the item offered to meet the government requirement, price, and Supplier Performance Risk System (SPRS) review to determine vendor responsibility.

This requirement will be procured in accordance with FAR Part 12 (Commercial Items) and FAR Subpart 13.5 (Simplified Procedures for Certain Commercial Items) procedures in anticipation of awarding a single award contract with firm fixed price provisions.

Please note the customer was unable to provide installation space restriction requirements.
