5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The existing contractor, Southeast Aerospace, Inc. (SEA) is currently installing airborne imaging systems on SG aircraft. To date, SEA has installed ten airborne imaging systems on SG aircraft and are scheduled to install 13 additional systems this year and with plans to install additional systems next year. SEA is the only responsible source that can provide a single source of supply to provide the necessary equipment during the short period of time that all aircraft are within the maintenance facility. Use of multiple sources will cause excessive aircraft downtime at increased costs to the government that are not anricipated to be recovered as a result of increasing competition.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
As this is a modification request to an existing contract, no effort will be made to solicit any potential sources.
A notice of intent to sole source will be posted.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
A determination has been made that the proposed cost is fair and reasonable. Market research has been conducted to compare the anticipated cost with current market prices, as well as costs that have been paid by previous contracts for special mission equipment.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Revised 2/26/2019 3
For the past several years, SG personnel have conducted on going market research to find sources that provide the necessary services to modify SG aircraft for the mission it is intended, that is to provide air support for investigative personnel. This market research consists of talking to aviation industry representatives, attending aviation industry trade shows such as the Airborne Public Safety Association, the National Business Aircraft Association and costs that have been paid by previous contracts for special mission equipment.
9. Any other facts supporting the use of other than full and open competition, such as:
i. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
A Statement of Objectives have been developed with detailed specifications and performance requirements.
ii. When 41 U.S.C. 3304(a)(1) is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
N/A
iii. When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
If this sole source contract modification is not approved for this requirement, then SG will be required to utilize multiple sources to supply the necessary equipment to perform its primary mission. This will cause excessive aircraft downtime at increased costs to the government.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
Southeast Aerospace, Inc.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
