JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)
AUTHORITY: 41 U.S.C. 253(c)(1) ONE RESPONSIBLE SOURCE
CONTRACT NO. 89304018CEM000004- Traynor Technical Project Services, LLC
1. The U.S. Department of Energy (DOE), Office of River Protection (ORP), is entering into a contract with Traynor Technical Project Services, LLC (TTPS, LLC) by means other than full and open competition. This document provides the justification and approval of the use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act of 1984 (CICA) and Federal Acquisition Regulation (FAR) Subpart 6.3 – Other Than Full and Open Competition.
2. Nature and/or description of the action being approved:
ORP plans to award contract 89304018CEM000004 to TTPS, LLC located at 100 Windward Way, Nicholasville, KY, 40356. TTPS, LLC is a service disabled veteran owned small business operating under NAICS Code 541690 – Other Scientific and Technical Consulting Services.
3. A description of the supplies or services required to meet the agency’s needs (Including the estimated value):
The purpose of this contract with TTPS, LLC is two-fold:
a. To provide expert technical and programmatic advice to the DOE-WTP Startup Commissioning and Integration (WSC) Assistant Manager for all work within ORP and with the WTP Contractor (Bechtel National, Inc. (BNI) and Waste Treatment Completion Contract (WTCC)) required to efficiently and safely commission and initiate operations of the WTP. This includes the following:
• Assuring the ORP oversight program to oversee WTP commissioning and readiness activities are conducted with the breadth and rigor required to provide DOE confidence that the WTP can be efficiently and safely commissioned and transitioned into radioactive operations. Provide DOE advice and solutions where performance improvement can be achieved.
• Assessing BNI and WTCC activities and programs to provide DOE confidence that the WTP will be efficiently and safety commissioned. Provide DOE advice and solutions where performance improvement can be achieved.
• Initial work will be focused on: 1) ORP organization and roles and responsibilities to provide oversight of the contactors work to commission WTP, 2) ORP strategy to oversee the Contractor’s commissioning and readiness scope, 3) Contractor strategy for commissioning and achieving readiness for hot commissioning, and
4) viability of the Contractor’s schedule given project and programmatic risks.
b. To provide expert technical support to the Assistant Manager WTP-WSC. This support will provide exclusive professional assistance which is essential in making and implementing decisions to be relied upon by DOE’s senior leadership and will be used for obtaining subsequent support and approval via the approval process established and required by DOE’s Washington DC headquarter staff and professional experts.
The estimated dollar value for this award is $759,451.00:
Base Year - $183,700.00 Option Year 1 - $187,732.00 Option Year 2 - $191,881.00 Option Year 3 - $196,138.00
4. An identification of the authority permitting other than full and open competition:
41 U.S.C. 253(c)(1) determines that only one responsible source exists and no other supplier or services will satisfy agency requirements
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The Department of Energy (DOE) Office of River Protection (ORP) has a compelling need for expertise in the construction completion, commissioning transition, and commissioning phase of the Direct Feed Low Activity Waste (DFLAW) project within the Waste Treatment Project at the Hanford site in Richland, Washington. Expertise and experience in this area of DOE work is in high demand. ORP has identified TTPS, LLC as a company that has this experience, contributing to specific functional areas such as senior contractor site commissioning and startup director at Salt Waste Processing Facility, senior project director owner’s representative for commissioning of the DOE’s DUF6 Conversion facilities, and lead test engineer for Naval Reactors in the building, commissioning, and reactor plant overhauls of the nation’s nuclear aircraft carriers.
TTPS, LLC is a service disabled veteran owned small business. TTPS, LLC is registered in SAM and has performed numerous contracts for the DOE at Idaho National Laboratory and at the DOE Portsmouth Paducah Project Office in Lexington, KY.
TTPS, LLC will aid ORP in progressing the DFLAW/WTP project towards completion.
TTPS, LLC has previously worked with ORP in varying capacities such as participation in Project Peer Reviews throughout the DOE complex and in performance of peer reviews at
WTP. For these reasons ORP desires to prepare and issue a direct sole source contract to
TTPS, LLC.
6. A description of efforts was publicized as required by FAR Subpart 5.2 to ensure that offers are solicited from as many potential sources as practical. This publication took place, on April 9, 2018 and ran through May 9, 2018. The result of this sole source publications was that there were no responses received.
ORP is currently not aware of any other qualified source and has not solicited other sources.
Accordingly, a notice of intent to award a sole source contract was publicized as required by FAR Paragraph 5.201(b)(1)(i) and described above.
7. A determination by the Contracting Officer was made that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer has evaluated the contractor’s price, along with other supporting documentation, and has made a determination that the cost/price is fair and reasonable.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Due to the unique nature of this requirement, DOE ORP does not know of, and has not solicited other sources. The Project Assistance Corporation (PAC) labor categories were reviewed under GSA contract number GS-00F-0051M. During a review of the data the technical monitor determined there were no other sources available from this source and PAC's labor rates were excessive when compared to those associated TTS, LLC.
A notice of intent to award a sole source contract was publicized on FedBizOpps on April 9, 2018, as required by FAR Paragraph 5.201(b)(1)(i). DOE ORP did not receive any responses to the synopsis.
9. Any other facts supporting the use of other than full and open competition.
None.
10. A listing of sources, if any, that expressed in writing, an interest in the acquisition.
There we no inquiries or expressions of interest during the 30-day FedBizOpps synopsis period beginning April 9, 2018 and ending May 9, 2018.
11. A statement of actions is listed below in the event DOE may determine to take to remove or overcome any barriers to competition, before any subsequent acquisition for the supplies or services are required.
