1b. Justification for Exception to Fair Opportunity

A.14 v2.00 2020.02.05

1. AGENCY AND CONTRACTING ACTIVITY:

Federal Retirement Thrift Investment Board OCFO Contracting Division 77 K Street N.E., Suite 1000 Washington, D.C. 20002

2. NATURE/DESCRIPTION OF ACTION(S):

FRTIB is requesting to sole source to AT&T for Telecommunication and Infrastructure Networx Services under expiring contract TIB-2018-F-0034.

ATT is the service provider for the Federal Retirement Thrift Investment Board (FRTIB) current network-based telephony transport and call handling capabilities for the Thriftline voice systems and network transport allowing Thrift Saving Plan participants voice calling access to the contact centers and allowing network connectivity between twelve FRTIB sites. The Mission of FRTIB is to provide retirement plan customer service to the participants and beneficiaries (P& B’s) of the TSP. The telecommunication transport capabilities of the TSP are geographically spread across twelve sites.

(Washington, DC; Fair Oaks, VA; Vienna, VA; Frostburg, MD; Clintwood, VA; Knoxville, TN; Kansas, MO; Birmingham, AL #1 - Birmingham, AL #2 - New Orleans, LA;

Dallas,TX; and Pittsburgh, PA) The ATT network-based telephony transport and call handling capabilities are provided as the following services (10Gbps ETHERNET PRIVATE LINE; AVPN PORTS; ETHERNET ACCESS TO AVPN; T1.5Mbps PRI ACCESS; PRI LD/TOLL FREE USAGE; SIP TRUNKING; and COMBINED SERVICES)

3. DESCRIPTION OF SUPPLIES/SERVICES:

The agency seeks to procure the use of (10Gbps ETHERNET PRIVATE LINE; AVPN PORTS;

ETHERNET ACCESS TO AVPN; T1.5Mbps PRI ACCESS; PRI LD/TOLL FREE USAGE; SIP TRUNKING; COMBINED SERVICES) services from ATT for (P& B’s) dialing access to the agency Thriftline and maintaining network transport communications at its twelve sites.

The period of performance requested is six (6) month base plus four (4) six (6) month option periods to allow for potential transition time for services to be moved to a new competitive task order under GSA’s EIS contract.

4. IDENTIFICATION OF STATUTORY AUTHORITY:

FAR 16.505 requires an ordering activity to justify its actions when fair opportunity is restricted. The specific circumstance that justifies restriction for this acquisition is FAR 16.505(b)(2)(i)(A), the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

The services under this task order are currently being competed under GSA’s EIS contract. However, an award will not be in made in time to prevent a lapse in service.

four (4) six (6) month options were included to allow for sufficient time to make a competitive award and to transition services.

5. DETERMINATION OF FAIR AND REASONABLE COST/PRICE:

The resulting task order price is deemed to be fair and reasonable in accordance with

FAR 15.4.

6. ANY OTHER SUPPORTING FACTS:

Other telecommunication service providers cannot provide some of the same service such as PRI LD/TOLL FREE USAGE access to our Thriftline voice systems. This service has dependent on the ATT Remote Call Forwarding service already provided by this vendor.

FRTIB has incorporated into its network-based telephony transport requirement diverse carrier access into all its sites to maintain high availability. Selecting a new vendor would require major changes of re-design, re-development, re-programming, re-testing and re-implementation for the application software(s) and supported hardware and software systems. A change of any kind is not feasible and would block access to the participants and beneficiaries accessing the Thriftline. It is in the best interest of the Government to continue these services with ATT until FRTIB transitions to EIS.

The current contract expires on September 28, 2020. FRTIB expected to have the new EIS in place by March 2020. The completion of the solicitation was delayed due to changes in the requirement. The RFQ has been posted and we are currently on track to award by November 2020. However, the transition of the current services provided by AT&T under this contract are expected to take at least six months. However, it may take longer. For this reason, we are requesting base plus four (4) six (6) month option periods. We request a sole source procurement to AT&T for Telecommunication and Infrastructure Networx Services currently under contract number TIB-2018-F-0034 as it is not fesible to recompete, award and possibly move service and then to move services again to another contract.

7. ACTIONS TAKEN TO REMOVE BARRIERS TO FAIR OPPORTUNITY:

The RFQ for this requirement has been posted and we are currently on track to award by 1st quarter of FY21.

3. DESCRIPTION OF SUPPLIES/SERVICES:
