4. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.

This action is being issued in accordance with the exception to fair opportunity Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(b). Specifically, it is recommended the order be issued on a sole-source basis as only Verizon is capable of providing the supplies or services required.

The CFTC issued Solicitation 9523ZY-20-Q-0008 under the GSA’s Enterprise Infrastructure Solutions (EIS) GWAC. Quotations are currently being evaluated with an award anticipated in early October 2020. Upon award of the delivery order resulting from the issuance of the solicitation, the services will need to be transitioned to the new order in a manner that will ensure no loss of service to

CFTC.

Verizon currently provides the services under Delivery Order 9523ZY-19-F-0079 and will be required to transition the services once the new delivery order is awarded. Verizon is the only vendor that can continue to provide the existing services. Further, Verizon is required to provide transition support to the new delivery order while ensuring there is no impact or degradation to existing services.

5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer has determined that the anticipated cost to the Government will represent the best value based on an analysis of the price proposed for this work and a comparison of the proposed rates with those outlined in the Verizon’s GSA Networx GWAC. The prices were previously determined to be fair and reasonable by a GSA Contracting Officer.

6. Any other facts supporting the justification. N/A

A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

The required services are currently being competed under GSA’s EIS contract with an award anticipated by October 2020. The solicitation was sent to all nine (9) EIS vendors, thereby providing for fair opportunity. Upon award of the EIS delivery order and transition of services, there will be no need for additional sole source procurement actions.
