About this file
This Justification for Exception to Fair Opportunity document details the Federal Bureau of Investigation's (FBI) intent to award a sole-source task order to Yankee Microwave Inc. for antenna installation services at the Wyndham City Center in Springfield, IL. The task order, valued at $52,761.00 with a six-month performance period, involves installing SuperSector and Cambium antennas for the FBI's Adaptive Central Receive (ACRx) microwave architecture, including all associated cabling, grounding, testing, alignment, permitting, electrical work, and site cleanup.
The FBI is pursuing a sole-source procurement because NAMSI LLC, the building's rooftop manager, has an exclusive arrangement with Yankee Microwave and requires all telecommunications equipment installations to be performed exclusively by this vendor. The procurement is being conducted under the AWS-3 Spectrum Relocation Program, with the Wyndham City Center selected due to being the tallest building in the Springfield region and offering optimal coverage for the FBI's operational video surveillance needs. The contracting officer has determined the cost to be fair and reasonable, based on Yankee Microwave's existing contract and previous similar installation service awards.

FAR 16.505(b)(2) Requisition Number: SHOP-PR-25-000169
Contract Number: 15F06720D0001560 Contract Name: ACRx Node Tower and Building Rooftop Antenna Installation Services Task Order Number: TBD Task Order Name: TBD Task Order POC: TBD
Date: 6/23/2025 Estimated Task Order/Delivery Order Dollar Value: $52,761.00
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for an Exception to Fair Opportunity.”
The U.S. Department of Justice, Federal Bureau of Investigation, Contract Unit, has prepared this Justification for an Exception to Fair Opportunity on behalf of the Video Surveillance Unit (VSU) within the Operational Technology Division (OTD).
2. Nature and/or description of the action being approved.
In accordance with a statutory exception to the fair opportunity process, the FBI contemplates award of a Firm Fixed Price task order to Yankee Microwave Inc. under contract number 15F06720D0001560 for antenna equipment installation services for the FBI’s Adaptive Central Receive (ACRx) microwave architecture at the Wyndham City Center Building at 700 E. Adams St. in Springfield, IL . The estimated period of performance for this task is six months from award date. The estimated cost for this task is $52,761.00 over the life of the task.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This work will include installation at Wyndham City Center of all SuperSector and Cambium antennas associated with the ACRx system, all cabling, grounding, testing, alignment, permitting, electrical work, a site visit for pre-installation planning, replacement cabling for an existing FBI VHF antenna, and site cleanup. Please see the SOW associated with this effort for full details. Estimated costs per quote from Yankee Microwave are $52,761.00.
Requisition Number: SHOP-PR-25-000169 Version 2.3 Page 2
4. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.
FAR 16.505(b)(2)(i)(B) - “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”
Yankee Microwave Inc. is uniquely qualified to provide these services to VSU under the AWS-3 Spectrum Relocation Program based upon the following:
The FBI requires installation of the ACRx system at the Wyndham City Center building at 700 E.
Adams Street in Springfield, Illinois. The building owner has granted exclusive rights for management of all rooftop telecommunications equipment to NAMSI LLC. As such, the FBI is bound by the requirements and constraints imposed by NAMSI LLC for use of the rooftop of this building for telecommunications equipment, including installation services. NAMSI LLC has entered into an exclusive arrangement with Yankee Microwave and as such requires any customers wishing to install equipment on the Wyndham City Center to use Yankee Microwave to the exclusion of all others. This is not something the FBI can control or dictate. NAMSI LLC has provided a letter attesting to this exclusivity arrangement with Yankee Microwave.
5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Yankee Microwave is a contract holder on the existing ACRx Installation IDIQ referenced above.
As such, their quote is in line and is fair and reasonable given the scope of the installation services being requested, which is very similar to multiple other installation service awards under this contract.
6. Any other facts supporting the justification.
The FBI selected this location based on operational need as the Wyndham City Center is the tallest building in the Springfield, IL region and offers the best coverage for the ACRx architecture for the FBI’s operational video surveillance needs. If installation were not done on this building, the result would be additional installation reuqirements at a considerable extra cost. We are familiar with Yankee Microwave’s work and have no concerns about their ability to execute to meet the FBI’s requirements.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
Given the exclusive arrangement for installation services imposed by the building rooftop manager, NAMSI LLC, no additional actions can be taken for this acquisition. Market research will continue to be conducted to identify potential opportunities to remove or overcome competitive barriers for future acquisitions.
