About this file

This is a Justification for Single Source Awards document under FAR 13.106-1 for a simplified acquisition not exceeding $250,000, issued by the Department of Veterans Affairs Network Contracting Office 16 in Houston, TX in support of Overton Brooks VA Medical Center (OBVAMC) in Shreveport, LA.

The contract is for monthly maintenance, testing, and unscheduled maintenance of OBVAMC's Bio-Amp system manufactured by NCH Corporation, with an estimated value of $54,151 over five years. The scope includes maintaining one Bio-Amp system in the canteen kitchen and two systems in the main kitchen, requiring all labor, equipment, supplies, and chemicals. NCH Corporation is justified as the sole source provider based on being the OEM and exclusive service provider. Market research included a Sources Sought Notice that received one inadequate response from SDVOSB Fyahworks Inc., a Notice of Intent to Sole Source with no responses, and searches of various government databases that yielded no viable alternatives. The document is signed by Contracting Officer Ross Futch.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

This system is manufactured by NCH Corporation located at 2727 Chemsearch Blvd, Irving, TX 75062-6454. They have provided written confirmation that they are the sole source service provider and sole source for the consumables required to maintain this system. Without a service conract, the cost of replacement of the existing Bio-Amp system is approximately $18,500.00. It is anticipated this cost could not be recovered through competition.

4. Description of market research conducted and results or statement why it was not conducted:

The Contract Specialist issued Sources Sought Notice number 36C25625Q0038 on 10/08/2024 to locate alternative sources for this work. One response was received from SDVOSB Fyahworks Inc.

The Contract Specialist issued Notice of Intent to Sole Source number 36C25625Q0091 on 10/23/2024. No responses were received from this special notice.

The Contract Specialist conducted a search under the SBA’s VetCert database which returned 307 Results.

The Contract Specialist performed a search of the contractdirectory.gov web site under “Bio Amp” which returned no results.

The Contract Specialist performed a search of the VA’s Supply Chain Master Catalog web site under “Bio Amp” which returned no results.
