About this file
This justification document provides approval for a sole source contract award to furnish photo equipment, monitors, and whiteboards for army classrooms. The army requires Nikon photo cameras and accessories to match existing equipment worth $950,000. Monitors were selected after market research determined brands that meet quality and functionality needs. A single vendor can provide the entire package for $399,962.41. Competition was initially sought from four local vendors but two could not fulfill all requirements, and the selected vendor demonstrated flexibility, cost-effectiveness, and responsiveness. The related solicitation is for life cycle replacement of outdated visual information equipment and furnishings for Building 3000 under opportunity number W912PB-23-R-3042 from the Department of the Army Materiel Command Army Contracting Command.

Sole Source Justification and Approval Under FAR 13.501
1. Contracting Activity: 409th Contracting Support Brigade, RCO Bavaria
2. Description of Action:
This Contracting Action is about the Life Cycle Replacement of outdated Equipment and the Furnishing of the classrooms in a recently completed building.
3. Description of Supplies/Services:
Nikon Photo cameras with the associated accessories as well as monitors and whiteboards for the classrooms see the appendix for more details.
4. Authority Cited: FAR 13.501
The required brands are due to the following fact: in the photo area, there is already an infrastructure that is completely tailored to the Nikon brand. There is a stock of Nikon optics worth around € 950,000 along with the associated accessories and training of the users. In the area of monitors, after intensive market observation and research, we have identified the devices which exactly meet the requirements we set in terms of quality and function.
5. Reason for Authority Cited
Due to the cross-discipline requirements, our initial research led to multiple providers being required to work together. After working together with various providers during the planning stage to fulfill the special requirements and was determined that the requirements could not be met by the mass of providers, we decided on a single provider who could offer us the entire package at a price relevant to the market.
6. Efforts to Obtain Competition:
During the planning phase for the equipment, we were in contact with four local providers (Barrowski AG, Kuchem Conference Technology, M-Medientechnik, CS- Congress Service). During our discussions, it turned out that two of the providers were unable to offer the complete package. For this reason, we then limited our efforts to the two remaining ones. We then decided on a provider who could also guarantee us flexible and reliable service. What was already extreme in the phase of preparing the offer was that our changes were reacted to promptly and more cost-effective alternatives were offered without request, which fully met our requirements.
7. Actions to Increase Competition: Please see item 6.

8. Market Research:
As market research, we used the opportunity to visit trade fairs and exhibitions, websites, and phone calls to possible vendors, as well site visits to various experience centers of the providers. By visiting the trade fairs (ISE and IBC as well as Photokina) we had the opportunity to gain an overview and more detailed insight into the functionality of the required equipment. Based on this experience and observations, we then created a requirement package tailored to our requirements and contacted various providers in this area.
9. Interested Sources:
To date after conducting thorough market research, no other sources, (to include the ones listed above) could orchestrate an all-in-one package service is required.
Competitive vendors were willing to service parts of the requests, but then decline when asked to service all because they didn’t have the resources.
10. Other Facts: The cost of utilizing multiple sources for procurement would be more expensive to the government and not time efficient to complete contracting purchase.
The need to quickly fulfill the life cycle requirements are time sensitive requirements, as the government will pull funding if purchases are not made timely.
