DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION LAKEHURST

ROUTE 547

JOINT BASE MDL NEW JERSEY 08733

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the procurement of IDSC Holdings LLC, doing business as Snap-On Industrial Corp. (Snap-On) brand name toolboxes in support of the Prototype, Manufacturing and Test Department Tool Control Program. The toolboxes will be procured via limited competition between Snap-On, the Original Equipment Manufacturer (OEM) located in Crystal City, IL (CAGE 55719) and its authorized distributors.

Toolboxes will be procured in support of the H-53K and C-130 Tool Control Program.

3. Description of Supplies/Services.

This brand name toolbox procurement is for complete toolboxes with customized tools for the programs referenced above, as well as partial toolboxes to complete a back fit of existing toolboxes. The program, tool grouping and amount of toolboxes are as follows: H-53K Program, Tool Groupings, complete toolboxes, as well as Tool Groupings, partial toolboxes to complete the H-53k back fit; C-130 Program, Tool Groupings, complete toolboxes. This effort is a continuation of the tools already in place at the squadron level, and each specific toolbox is designed to accomplish a specific maintenance task on all H-53K and C-130 aircraft variants. This provides the fleet and international forces with standardized toolboxes ensuring that all tools are accounted for upon completion of each maintenance task, which is critical to mission readiness and safety of flight.

Further, training is conducted utilizing these identical toolboxes. In order to ensure that all service members trained on servicing H-53K and C130 aircraft/equipment can perform their designated tasks no matter where they are located. H-53K and C-130 tools are the same from one squadron to another, both for U.S and international forces.

The estimated value of this procurement is and will be funded with

After Snap-On brand name tools were approved, over was invested in designing, prototyping, and programming equipment to design templates and manufacture specific toolbox cut outs for each toolbox. The toolbox individual tool templates have been precisely designed and programmed to accommodate Snap-On tools. The location of the material is across the fleet for H-53K and C-130. Any replacement would have to go through the same process of testing, validation, approval and the back fitting to all previous procurements. This process would include imagining, creating new files, and creating files in master cam for each tool. Introducing a new supplier of non Snap-On tools would have an estimated reprogramming cost of for a layout of all toolboxes based on the assumption that of the latest tools would have different profiles than their Snap-On counterparts.

In addition to the costs above, any proposed tool change would require a validation/verification procedure on the new tool to ensure that the new tool would function appropriately in the H-53K and C-130 maintenance environment. This verification process would include on–aircraft fit checks, which is not always available due to the lack of aircraft availability for testing purposes.

In some cases, this may also include evaluating the compatibility of the new tool with the existing tools in the toolbox. Also, additional logistics costs, such as Joint Technical Data maintenance manuals would require updates, and deployed toolboxes would require retrofits to ensure configuration management across the fleet. Finally, training courses may require updates to identify new part numbers, toolbox design, etc. The cost and time to accomplish these changes would be significant based upon the number of non Snap-On tools selected and the number of maintenance manuals and training courses affected. If any new configuration was introduced, preexisting tools and toolboxes would have to be replaced with new configurations.

Given the above, Snap-On and their authorized distributors are the only known sources that can fulfill this requirement without significant impact on the H-53K and C-130 programs and maintenance activities. As discussed herein, awarding to any other source would substantially duplicate costs that would not be recovered through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offers as Practicable.

Market research was conducted utilizing various methods to identify possible sources for the required equipment and to obtain current information in regards to availability and price. A search was conducted using the tools nomenclature and part numbers in the stock system, which resulted in only one manufacturer, Snap-On. Additional market research was conducted by the Tool Control Program to identify authorized resellers or distributors for the Snap-On tool toolboxes through direct meetings and trade shows. As a result, it was discovered that Snap-On has authorized distributors and resellers for the required equipment.

A Request for Information (RFI) was posted to the System for Award Management (SAM) website SAM.gov on 03 November 2022 and closed on 08 November 2022. No responses were received.

Based on the market research performed, it is the Government's intention to issue a solicitation on SAM.gov to award a contract for the required Snap-On brand name tools. In accordance with Federal Acquisition Regulation Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Products and Commercial Services, a combined synopsis/solicitation will be posted.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/service covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For reasons stated above in Paragraph 5, only Snap-On brand name toolboxes can meet the Government’s requirements. The Tool Control Program will continue to canvas the tool industry (manufacturing and suppliers) through various direct meetings and trade shows for other manufacturers to potentially increase competition.

Because this is a follow-on for supplies previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior justification is provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
