About this file
This is a Justification and Approval (J&A) document for other than full and open competition under the Revolutionary Federal Acquisition Regulation (FAR) Overhaul, prepared by the Defense Health Agency's Defense Health Network - East.
The Government seeks to award a firm-fixed-price contract to the Tennessee Department of Health, Division of Laboratory Services, for commercial newborn dried blood spot screening laboratory services and associated reporting for newborns delivered at Blanchfield Army Community Hospital in Tennessee. The contract includes a 12-month base period beginning November 1, 2026, and ending October 31, 2027, followed by four optional 12-month periods and a potential six-month extension under FAR 52.217-8. The total potential contract value, though redacted in the document, encompasses all periods through April 30, 2032. Base period funding will utilize available FY 2027 appropriations, with option and extension exercises contingent on fund availability and fiscal law compliance. The contractor must receive, test, analyze, and report results for newborn dried blood spot specimens in accordance with Tennessee Code Annotated § 68-5-401 and Tennessee Comp. R. & Regs. 1200-15-01-.02, which mandate that all satisfactory newborn blood specimens be submitted to the State Public Health Laboratory. The requirement excludes newborn hearing screening, critical congenital heart disease screening, and other clinical screening functions. No competitive alternatives exist because Tennessee state law requires specimen submission exclusively to the State Public Health Laboratory, making the Tennessee Department of Health the only qualified source. Market research confirmed that the proposed price is fair and reasonable based on current and historical state-established fees and independent Government cost estimates. The contracting officer will publicize this acquisition as a commercial services acquisition in the Governmentwide Point of Entry, identifying the intended source and explaining the competition restriction, and will evaluate any responsive capability statements or proposals to confirm compliance with Tennessee requirements.

7. Actions to Increase Competition/Remove or Overcome any Barriers to Competition:
The principal barrier to competition is Tennessee's requirement that satisfactory newborn blood specimens be submitted to the State Public Health Laboratory, Department of Health.
Before exercising each option, the requiring activity and contracting officer will conduct updated market research and review applicable Tennessee statutes, regulations, TOH newborn screening procedures, and responses to public notices to determine whether any change would permit another source to meet the Tennessee-required submission process. The results of this review will be documented in the contract file.

R. & Regs. 1200-15-01-.02; Tennessee Department of Health newborn screening program information; Tennessee Department of Health Division of Laboratory Services information; current, historical fees and TOH-established fees
