JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
FAR Subpart 6.302-1 Global Council Executive Membership
1. Contracting Activity:
Department of Veterans Affairs Office of Procurement, Acquisition and Logistics (OPAL) Strategic Acquisition Center (SAC) 10300 Spotsylvania Ave, STE 400 Fredericksburg, VA 22408
2. Description of Action:
The proposed action is a renewal of VA Office of Acquisition and Logistics (OAL) Membership to the Project Management Institute (PMI) Global Executive Council. This proposed sole source action is for a firm-fixed price (FFP) contract with a 12-month base period and with four, 12-months option periods.
Base Period: September 30, 2021 – September 29, 2022 Option Period One: September 30, 2022 – September 29, 2023 Option Period Two: September 30, 2023 – September 29, 2024 Option Period Three: September 30, 2024 – September 29, 2025 Option Period Four: September 30, 2025 – September 29, 2026
The base period estimate of $5,000 reflects the annual membership price. The Independent Government Cost Estimate (IGCE) and market research revealed an estimated total value of $25,000 for the base and the four (4) option periods.
3. Authority:
The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
4. Rationale Supporting Use of Authority Cited Above:
PMI is one of the premiere institution in the United States for project management services and is the only recognized entity that provides the required resources: PMI Global Executive Council Membership. PMI is the exclusive provider of the Global Executive Council and purchase of membership will provide the VA and OAL access to innovative proprietary research, seminars, networking, publications, project management tools and templates; otherwise unavailable or prohibitively expensive and therefore represents a significant cost savings to the VA. Membership to PMI Global Executive Council will allow OAL access to resources that will greatly impact and improve the existing acquisition workforce training.
5. Efforts to Obtain Competition:
Market research was conducted, details of which are in the market research section of this document. The research yielded no additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition.
Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated.
6. Actions to Increase Competition:
Currently only one company has the Global Executive Council Memberships. A pre-solicitation notice for non-competitive requirement was posted to beta.sam.gov on August 25, 2021. No response was received by any other vendor indicating that a similar membership can be provided. The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.
7. Market Research:
This requirement has been sole sourced since the inception of Program Management Improvement and Accountability Act (PMIAA), now Public Law 114-264. Required sources were searched to include but not limited to GSA, AbilityOne, Dynamic Small Business Search and a Google search. More information is available in the Market Research Memorandum.
Based on the searches during market research there are no Government identified SDVOSBs or VOSBs that have Global Executive Council Memberships. The select services are not readily available on an existing purchasing vehicle (such as a GWAC, Internal IDIQ, GSA FSS, Ability One, etc.)
Project Management Institute is the only organization outside of VA with the necessary training and experience to provide the necessary services outlined in this contract due to the time requirement and the high standards set by the developer to bring people together to discuss and improve the workplace environment. Project Management Institute is able to provide the necessary services with no additional training needed.
8. Other Facts:
No other relevant facts.
9. Technical and Requirements Certification:
I certify that the foregoing justification is complete and accurate to the best of my knowledge and belief, pursuant to (FAR 6.303-2(b)(12)), Alexandra Wile Date Office of Acquisition & Logistics Contracting Officers Representative
10. Determination of Best Value:
I hereby determine the proposed contract action will represent the best value to the Government. No award shall be made until the Contracting Officer determines the cost to the Government to be fair and reasonable. Additionally, this determination will include a comparison of current contract pricing, past proposal submissions and an Independent Government Cost Estimate. The Government’s intention is to award based on the capability, price reasonableness, and is in the best interest of the Government.
Pursuant to (FAR 6.303-2(b)(12)), I certify that this justif ication is accurate and complete to the best of my knowledge and belief.
Mauricio Vazquez Date Chief, Acquisition Services Div 4A Contracting Officer
