DEPARTMENT OF THE NAVY
FLEET LOGISTICS CENTER
CONTRACTS DEPARTMENT, PHILADELPHIA OFFICE
700 ROBBINS AVENUE, BUILDING 2B
PHILADELPHIA, PA 19111-5083
J&A Number: 20-038
JUSTIFICATION AND APPROVAL FOR USE OF SOLE SOURCE
1. Contracting Activity.
The requiring activity is the OPNAV N170D, US Navy Drug Detection & Deterrence Program (OPNAV N170D).
The contracting activity is NAVSUP FLC Norfolk Contracting Department, Philadelphia Office; 700 Robbins Ave. Bldg. 2B;
Philadelphia, PA 19111-5083.
2. Description of the Action Being Approved.
This is a sole source action, to be awarded as a new contract to Prevention Research Institute, Inc. for the acquisition of PRIME for Life®, a substance abuse prevention service for sailors across the Navy. The placement of a Firm Fixed Price (FFP) contract is anticipated.
3. Description of Supplies/Services.
The instant requirement is for the procurement of Prime for Life substance abuse prevention services for delivery to members of the Navy’s active and reserve components, regardless of their area of operation. These services include a classroom-based intervention strategy that addresses substance abuse and a separate computer-based intervention strategy for selected/high-risk and isolated populations.
The total estimated value of this requirement is $478,490. The NAICS code is 813212 and the service code is D399. The requirement is anticipated to include a one-year base, and one (1) one-year option period thereafter, as follows:
Base (FY20 OPNAVN1 O&MN Funding) 14 July 2020 – 13 July 2021 Option Year I 14 July 2021 – 13 July 2022
4. Statutory Authority Permitting SOLE SOURCE.
The instant requirement is subject to Section 4202 of the Clinger-Cohen Act of 1996 - a sole source acquisition under the authority of simplified procedures for certain commercial items, as implemented by FAR 13.501(a) Sole Source. The service under the instant requirement is not available from sources of supply, outlined in FAR Subpart 8.002 and is to be acquired in the “open market”.
5. Rationale Justifying Use of Cited Statutory Authority.
The US Navy Drug Detection & Deterrence Program (OPNAV N170D) provides programs, products and services for specialists in the areas of substance abuse reduction, prevention education, policy development, research, and command guidance. OPNAV N170D is the office of record for all statistical information on substance abuse within the Navy and is responsible for managing a robust urinalysis testing program Navy-wide.
The demands of military operations over the past decade have placed significant stress on Sailors, increasing the tolerance and discipline required to avoid high-risk behavior. The resultant strain has given birth to a significant recognition (as a result of its research efforts) in the incidence of substance abuse throughout the Navy active and reserve component. Substance abuse undermines morale, mission performance, safety, health and effectiveness of its members. Senior leaders of the Navy find this behavior to be inconsistent with the core values of honor, courage, and commitment.
In response to the circumstances described, OPNAV N170D is in need of a deployable training tool that simultaneously meets the requirement of an expeditionary deterrence program. This type of program greatly enhances OPNAV N170D’s capabilities to deliver services to sailors in geographical locations away from established prevention resources that include recruiters, reservists, and deployed sailors. This service must ultimately mitigate the increased high-risk behaviors that have resulted from recent and long-term high operational tempo demands.
Through market research, it is determined that Prevention Research Institute Inc (PRI). is the only vendor, with the unique qualification that can deliver the program to sailors, in various age groups, both in class and online, in geographical locations away from established prevention resources that include recruiters, reservists, and deployed sailors. PRI’s product, Prime for Life, does not have limiting age or substance coverage restrictions that are found in other product offerings. Prevention Research Institute Inc. can deliver the program to sailors, in various age groups, both in class and online, in geographical locations away from established prevention resources that include recruiters, reservists, and deployed sailors Prevention Research Institute, Inc, is the only know authorized seller of Prime for Life. As a result, only one source, Prevention Research Institute, Inc., can reasonably provide OPNAV N17 with the requisite services to support its Drug Detection & Deterrence Program.
The procurement of this service will help OPNAV N170D to: 1) Reduce the incidence of substance abuse throughout the active duty and reserve Navy, 2) Increase opportunities for service members to self-refer, 3) Expand the Navy’s prevention training capabilities, and 4) Fulfill its responsibilities outlined in DODI 1010.04, DODI 1010.06, SECNAVINST 5300.28, and OPNAVINST 5350.4. This product is critical to the Sailors recovery and well-being when returning to the Fleet healthy.
If the service is not contracted for as described, the Navy will not be able to reduce substance abuse related risk to the sailor and improve comprehensive fitness/readiness throughout the Navy (Active and reserve component).
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted by reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line, by contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirement, and by reviewing the results of recent market research conducted on 5/9/2019.
The results of the market research are summarized as follows:
Research was conducted using the internet, specifically though reviewing substance abuse prevention programs recommended by the Substance Abuse and Mental Services Administration (SAMHSA) website.
https://www.samhsa.gov/find-help/prevention. Five substance abuse prevention programs were recommended by the SAMHSA website. One (1) program has an age restriction of 21. This is unacceptable because there is no age restriction to sailors accessing the service. Two (2) programs were not continuous in performance, with monthly or bi-yearly services. Two
(2) other programs were offering prevention programs specific to underage drinking, which is unacceptable in both the substance range offering and the age requirement. None of the programs fulfilled the needs of the government.
In addition, market research was conducted by reviewing the results of recent market research undertaken to meet a similar requirement. With intent to identify other vendors, an industry expert (Hazelden – Betty Ford Center) was contacted regarding availability of vendors who could offer the product. The Hazelton Betty Ford Center proposed several products, which could only meet a few of the requirements; but none could meet all requirements. The primary disqualifying factor was the age restrictions of the offerings. The Hazelton Betty Ford Center also stated that it could not direct the Government to another known available product that could meet OPNAV N17D’s requirements.
The Prevention Research Institute, Inc., which offered Prime for Life® and MyPRIME®, is used by agencies that include the DoD (Army & USMC) and Homeland Security (Cost Guard). The program combines instructional techniques and computer-based training product that are specific to the military audience. Unlike the previous programs mentioned above, this program does not have limiting age or substance coverage restrictions, found in other vendors. Prevention Research Institute Inc. can deliver the program to sailors, in various age groups, both in class and online, in geographical locations away from established prevention resources that include recruiters, reservists, and deployed sailors.
Prevention Research Institute, Inc., is the only known source that can reasonably provide OPNAV N17 with the requisite service (Prime for Life) to support the needs of the Drug Detection & Deterrence Program. Based on the information herein, it is in the best interest of the government to pursue a sole-source acquisition, with award to Prevention Research Institute, Inc. in accordance with the information herein and with FAR 13.501(a) Sole Source.
https://www.samhsa.gov/find-help/prevention
7. Determination of Fair and Reasonable Cost. A fair and reasonable determination will be based on price analysis, which will be conducted by the Procuring Contracting Officer, using the contractor’s offer and/or a comparison of previous pricing history, published price list of same or similar items, or any other reasonableness, in accordance with FAR15.404- 1(b).
8. Actions to Remove Barriers to Future Competition.
All future requirements will be handled on a case by case basis. If another potential source emerges, NAVSUP FLC Norfolk, Philadelphia Office will assess whether competition for future requirements is feasible.
9. CONTRACTING POINT OF CONTACT
NAVSUP Fleet Logistics Center, Norfolk, Contracts Department, Philadelphia Office point of contact concerning this action is Alina Yarmakovich, Code 260.1, who may be contacted at (215) 697-9605, or by e-mail at alina.yarmakovich@navy.mil.
