About this file

The document is a U.S. Coast Guard Justification for Other Than Full and Open Competition using Simplified Acquisition Procedures (SAP) for a sole-source procurement. The Coast Guard requires the evaluation, repair, and calibration of 8 USM-708 Common Radio Aircraft Functional Test (CRAFT) Sets, with an option to add 10 more units, to check the quality and performance of aircraft navigation and identification friend-or-foe (IFF) communication systems. The procurement is specifically targeted to Tel-Instrument Electronics Corp., the original equipment manufacturer (OEM), as they are the only domestic company with access to the required service manuals, technical data, and classified interface specifications for these test sets.

The justification emphasizes that Tel-Instrument Electronics Corp. is the sole authorized repair provider due to proprietary rights over the technical data and the test sets' direct interface with a classified CRYPTO Applique KIV-78 system. The contract will include an addendum allowing the Coast Guard to request additional unit evaluations and repairs at the same price and terms within one year of award. The Contracting Officer will determine fair and reasonable pricing through comparison with previous purchases and similar industry items. A combined synopsis/solicitation will be posted on SAM.gov, allowing other sources to submit capability statements, though the document strongly suggests Tel-Instrument Electronics Corp. is the only viable vendor for these specialized services.

THROUGH YOUR MARKET RESEARCH TO SUPPORT THE JUSTIFICATION TYPE:

The Original Equipment Manufacturer (OEM) of these Test Sets is Tel-Instrument Electronics Corp. (CAGE Code 92606). Tel-

Instrument Electronics Corp is the only domestic company with access to the service manuals, technical data, performance specifications, and drawings required to perform repairs to these Test Sets. The USM-708 has a direct interface with the CRYPTO Applique KIV-78

(Classified) to perform IFF Mode 5 Interrogations. Tel-Instrument Electronics Corp is the only vendor approved for and authorized to access this classified data, making them the only vendor capable of servicing the subject test equipment. While there are several non-U.S.

manufacturers with access to the required technical information, these companies act as their country’s sole agents for the sale, calibration, and repair of Tel-Instrument Electronics Corp equipment. As such, all service requests received from the U.S. would be referred to Tel-Instrument Electronics Corp.

Market research has revealed that Tel-Instrument Electronics Corp. is the only authorized repair provider for these test sets. Tel-

Instrument Electronics Corp. owns all rights to the service manuals, technical data, performance specifications, and drawings required to perform evaluation, calibration, and repair work on these Test Sets. The proprietary rights to the technical data necessary to have this equipment serviced by other than the OEM are not owned by the Government nor are they licensed to any commercial sources, and the

OEM has no intention of selling these rights. In addition, the Government has not developed or reverse engineered the technical data required to service and repair these Test Sets and has no plans to do so. The Test Sets interface with the classified CRYPTO Applique

KIV-78 Communications Security (COMSEC) IFF system severely limits the accessibility of the data required to perform calibrations and repairs.

These services are not available from any mandatory Government source IAW FAR 8.002 or from any non-mandatory source IAW FAR

8.004. Tel-Instrument Electronics Corp. does not have any other authorized repair facilities. A combined synopsis/solicitation will be posted to the Contract Opportunities section of the web site at www.sam.gov. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.
