SINGLE SOURCE JUSTIFICATION NOT EXCEEDING THE SIMPLIFIED ACQUISITION

THRESHOLD

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Department of State Contracting Activity Overseas Post: Rabat, Morocco

Requiring Activity Warehouse Support Services

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Approval is requested to award on a sole source basis to a vendor for the supplies and/or services described in Section 3 on behalf of the Requiring Activity. The period of performance for the current contract will end on January 31, 2025. The purpose of this bridge contract is to provide continued warehouse support services to the Mission of Morocco from February 1 to July 31, 2025. This extension allows time to re-publish the solicitation, receive competitive offers, evaluate them, and award a new contract since unresolvable contracting issues have developed with the current conditional awardee. Due to this unforeseen external factor beyond the Mission’s control and to the complexity of the Mission's needs, an extension of the contract with the incumbent vendor is deemed necessary and urgent.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The requirement is to provide moving and transportation services among Embassy’s and Consulate General’s premises such as warehouse, houses, apartments, and offices located throughout Temara, Rabat, and Casablanca, Morocco. The estimated value for the entire period of performance is $80,000.00. These supplies/services require that the Contractor shall provide transportation and handling services for the U.S.

Embassy, Rabat, and the U.S. Consulate General in Casablanca. The Contractor shall perform warehouse support services for property owned or managed by the U.S. Government in Rabat and Casablanca, Morocco.

The Contractor shall furnish all direct labor personnel necessary to accomplish the work in this contract.

Contractor employees shall be on site only for contractual duties and not for other business purposes. This will allow the Office of General Services to accomplish Mission compelling objectives including furniture preparation for arriving USDH employees, representational event setups, auction disposals, and receiving.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:

FAR 6.302-2 – Unusual and compelling urgency.

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY

CITED

The current contractor is the only vendor able to provide these services on an uninterrupted basis for a six-month period, while Post conducts full and open competition and awards a new warehouse support service contract. The current set of laborers have been working with the Embassy for many years and their names have already been vetted by the Regional Security Office. They are also familiar with the type of work that needs to be done. The contractor has the required experience, knowledge, ability, and manpower to perform needed services. This acquisition is conducted under the authority of FAR 6.302-2 - Unusual and compelling urgency. Due to unforeseen external factors beyond the Mission’s control and due to the complexity of required services, it is not practical to compete a bridge contract and transition services to another contractor to provide continuing warehouse support services for more than 400 employees on a short-term basis. All interested sources will be given the opportunity to participate in the solicitation for the new contract under full and open competitive procedures when the solicitation is released and re-published.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT IS FAIR AND REASONABLE

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

SECTION 7. CERTIFICATIONS

All reviews and approvals should be completed in the order listed unless otherwise authorized or required.
