SIMPLIFIED ACQUISITION PROCEDURES (SAP)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION THAT LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.

STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

1. PURCHASE REQUEST OR REQUISITION NUMB

2. PROJECT/TASK NUMBER

N/A

3. ESTIMATED AMOUNT (OVER $2,500 BUT

NOT EXCEEDING $24,999.99)

2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE.

IMCOM enterprise solution to hunting, fishing and timber/firewood permit sales. iSportsman increases situational awareness and safety by centralizing the management of recreational activity in testing and training areas. Range Operations will be able to post real-time updates of hunting and fishing area closures and alerts in response to changing testing mission requirements. These real-time updates will be visible to recreationists and Conservation Law Enforcement officers to facilitate clearing of hunting and fishing areas when needed. Additionally, iSportsman aids law enforcement in ensuring recreationists are following proper range access and clearing procedures as well as adhering to recreational hunting and fishing regulations. iSportsman will support the APG/ALC goal of sustainable management of natural resources by improving access to harvest data. Recreationists will be able to submit real-time harvest reports through iSportsman. This will streamline harvest data collection and facilitate the data analysis required for wildlife and fisheries management.

3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR

SERVICES CAN BE USED

ASciS is the sole owner and seller of the iSportsman system. iSportsman is the only FedRAMP authorized software as a service that provides the following functions: iSportsman ties together a user-friendly user interface with a database and interactive GIS for user registration, permit sales, area check in/out, data collection and safety briefs with text and messaging alerts and program updates to users. This stand-alone system is accessible 24/7 from any web connection by law enforcement, Range Operations, natural resources program managers and recreationists.

4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:

Market Research was conducted through CHESS, GSA, and Beta Sam through sources sought announcements.

The CHESS RFQ, reference # 344488, was issued on 29 October 2020 and closed on 05 November 2020. It was not anticipated that the contractors could meet the requirements established in the PWS and this solicitation would primarily be used to determine that capability and prepare for a Statement of Non-Availability (SoNA) waiver. The RFQ closed on 10:00 EST, 05 November 2020. 25 of 31 vendors responded; no contractor was able to meet the requirements established. A SoNA Waiver was submitted to CHESS on 05 November 2020.

After a survey of the categories, “MAS: 511210” was determined to be the best fit for this requirement. RFQ 1465993 was posted 29 October 2020 and closed 05 November 2020; 20:00 AM EST. The RFQ was left open to all contractors under MAS: 511210, totaling 892 contractors. Nine (9) responses were received, all establishing “no quote” available.

Therefore, the contractors available under GSA are not able to meet this requirement.

On 29 October 2020, a sources sought announcement was posted on beta.sam.gov. Three responses were received;

from Intekone, OnPoint Consulting, and ASciS. ASciS was the only contractor to present capabilities that met the mission requirements. This determination was made by Jessica Baylor, Forester and Natural Resources Lead, jessica.m.baylor.civ@mail.mil. ASciS is a small disadvantaged business. No other contractors were found.

There is no excess from other Government Agencies. UNICOR and Ability One do not offer these services.

5. EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

At this time, only one contractor has the software being utilized by the Government. The market research demonstrated in Item 4 of this document provides further evidence.

6. PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. IF THIS IS A FOLLOW-ON ACTION TO A PREVIOUSLY COMPETED

ACTION, SO STATE:

The Government will post a Notice of Intent to Sole Source for 15 days to ensure no other contractors can meet the mission requirement.
