JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:

DLA DISTRIBUTION

2. NATURE/DESCRIPTION OF ACTION BEING APPROVED:

Contract SP3300-21-D-0005 was awarded on September 27, 2023 to Unity Technologies Corporation (UnityTec) in the amount $20,826,553.22. The ordering period was from April 1, 2021 through March 31, 2026. The contract was for professional services in support of DLA Distribution J3. Specifically, the Contractor provides program management, data collection, analytical support, transition support, business case analysis support, process mapping and standardization model services and graphic artist/multimedia design support to compliment current DLA technical and operational expertise in executing its mission in areas that include, but are not limited to, personnel/manpower staffing, organizational development and resource studies, storage or performance optimization initiatives.

The contract is a hybrid-type contract with Fixed-Price line items for professional support services and a Cost-Reimbursement line item for travel. The contract was competitively awarded as a 100% small business set-aside.

Five task orders have been awarded under the contract. To ensure uninterrupted service and ongoing support to customers, DLA Distribution will award a modification to extend services from April 1, 2026 through September 30, 2026. The current task order, SP3300-25-F-0375, will be extended for three (3) months.

Upon completion of the task order a new task order will be awarded with a performance period of July 1, 2026 through September 30, 2026.

3. DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET AGENCY’S NEEDS:

DLA Distribution J3 has a requirement for Professional Support Services to include program management, data collection, analytical support, transition support, business case analysis support, process mapping and standardization model services and graphic artist/multimedia design support to compliment current DLA technical and operational expertise in executing its mission in areas that include, but are not limited to, personnel/manpower staffing, organizational development and resource studies, storage or performance optimization initiatives.

4. IDENTIFICATION OF STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) or 41 U.S.C.

3304(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements

(FAR 6.103-1, DFARS 206.104-72).

5. DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF

ACQUISITION THAT REQUIRES USE OF THE CITED AUTHORITY:

DLA Distribution has a requirement for program management, data collection, analytical support, transition support, business case analysis support, process mapping and standardization model services and graphic artist/multimedia design support to compliment current DLA technical and operational expertise in executing its mission in areas that include but are not limited to personnel/manpower staffing, organizational development and resource studies, storage or performance optimization initiatives.

Authority, in accordance with FAR 6.103-1, is appropriate in this instance for the government to avoid incurring substantial duplication of costs that would not be recovered through competition. It would also cause unacceptable delays in service and disruption to the mission. Issuing a new contract to another contractor would not be logical, efficient or cost effective to the government.

6. SYNOPSIS ANNOUNCEMENT/POTENTIAL SOURCES:

A synopsis will be publicized on SAM.gov of the government’s intent to extend services of the contract, extend the current task order and issue a sole-source task order as required by FAR 5.201 and in accordance with the procedures at FAR 6.103-1.

Market research shows there are numerous commercial companies available that perform program management, data collection and analytical support services, in their normal course of business, that can complement current DLA technical and operational expertise in executing its mission. These companies have in-house knowledge and technical expertise, or the resource ability to subcontract, to provide program management, data collection and analytical support services.

7. DETERMINATION OF FAIR AND REASONABLE COST:

Extending the services of the contract is the most advantageous method of fulfilling the Government’s need for uninterrupted support. The modification will not increase the contract ceiling and the Government will determine the prices are fair and reasonable on the task order. This is accomplished through a technical review of the task order proposal and price realism analysis which will be documented in the task order file.

8. DESCRIPTION OF MARKET RESEARCH:

This acquisition was initially solicited as a 100% small business set-aside. There were numerous commercial companies available that perform program management, data collection and analytical support services, in their normal course of business, that can complement current DLA technical and operational expertise in executing its mission. These companies have in-house knowledge and technical expertise, or the resource ability to subcontract, to provide program management, data collection and analytical support services.

10. LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN

THE ACQUISITION:

Market research was performed and numerous vendors exist in the marketplace that can provide the required services. This acquisition was initially identified as 100% small business set-aside. Thirteen proposals were received in response to the solicitation.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE/OVERCOME BARRIERS BEFORE

ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES/SERVICES IS

REQUIRED/MADE:

The current requirement was awarded as a 100% small business set-aside. Based on the market research and the numerous proposals received on the current contract, it is reasonable to conclude future requirements can be satisfied as a 100% small business set-aside.

12. STATEMENT OF DELIVERY REQUIREMENTS:

This will be a modification to extend the period of performance of the contract in accordance with FAR 52.217-8, Option to Extend Services. In addition, the current task order will be extended for three (3) months and upon its completion a new task order will be issued for three (3) months.

13. TOTAL ESTIMATED DOLLAR VALUE OF THE ACQUISITION(S) COVERED BY THIS

JUSTIFICATION:

The Estimated Total Dollar Value is $2,659,700.80
