I. Contracting Activity.
502 CONS/JBKAD-JBSA Lackland, TX
II. Nature and/or description of the action being processed.
The purpose of this action is to modify the existing task order FA8056-15-D-0011-SM03 to address a differing site condition on the Ft. Sam Houston, Building 2792 Roof. During demolition of the existing roof, the contractor identified 167 rotten structural rafter tails (beams). The rafter tails are essential to the entire roofing infrastructure. The contractor notified the government of the differing site condition and work was suspended with the demolished roof remaining open. During suspension the local area has incurred significant rain fall. The rain has flooded the third floor, infiltrated the walls, damaged wall coverings, potentially damaged fire suppression systems, potentially damaged public address system, destroyed ceiling tiles, and created mold. The current task order was awarded solely for tile roof replacement.
The intent of the Air Force Installation Contracting Activity (AFICA) Indefinite Delivery Indefinite Quantity (IDIQ) contract is for roofing only not structural repair.
Ft. Sam Houston, Building 2792 houses Army Medical Command Headquarters. Their mission consists of providing sustained health services and research in support of the total force to enable readiness and conserve the fighting strength while caring for soldiers and families. Mission requirements are worldwide and the impact is substantial for military members. The third floor currently houses 125 personnel with 100 additional personnel inbound. The total workforce of building 2792 consists of 618 working professionals.
III. Description of supplies/services required to meet agency needs.
This modification will incorporate new work to remove and replace 167 structural rafter tails, damaged fascia board, roof decking, gutters, and complete tile roof replacement. All damaged and deteriorated tongue and groove wood deck shall be replaced. Work is to be performed on a historical building. The rafter tails must be #2 smooth western red cedar to meet historical building standards. The period of performance required for structural repair is 120 days and will utilize Fiscal Year 2018 funding.
IV. Statutory authority permitting other than full and open competition.
In accordance with FAR 6.302-2 and 41 U.S.C. 3304(a)(2), the agency's need for supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits proposals. In addition DFARS PGI 206-302-2 (b)(iii) allows this authority for, construction needed at once to preserve a structure or its contents from damage.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The original task order for roof repair is for $1.3M placed on the AFICA IDIQ. This modification will incorporate new work for structural rafter tail replacement. This is a historical building and is a secured facility. The current contractor has the ability to expedite demolition, replace the structural rafters, and carry on with the tile roofing work already on task order. This solution provides a streamlined approach to rectify the missing roof and protect the health and welfare of Department of Defense personnel.
The current contractor Express Abeco Joint Venture has demolished the existing roof and is currently suspended until the differing site condition can be resolved. The roof is open and exposed to the elements. This modification to incorporate the structural rafter tail replacement is urgent and compelling based on mission impact and the health and welfare of all Army Medical Command personnel housed at building 2792. 618 personnel with an additional 100 personnel inbound are subject to the adverse health conditions of working in a facility with identified mold accumulation caused by the condition. In addition, the personnel assigned to the third floor are exposed to a leaking

FOR OFFICIAL USE ONLY14 Nov 2017 ceiling, flooded walls, destroyed ceiling tiles, and destroyed wall coverings. The potential fire suppression system damage also creates significant safety concern for all personnel. The Facility Manager has stated, "It is probable that failure to complete this project will result in eventual abandonment of the facility with serious degradation of mission unit function until such time that a new facility can be built".
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The unusual and compelling requirement was not solicited to multiple sources. Although FAR 6.302-2 is not an exclusion to competition, this emergent repair is effecting the life, health and safety of more than 600 personnel and jeopardizing the integrity of the facility and it's systems. The current contractor has a task order for tile roof repair and has completed remediation to limit the damage to the government.
The roof tile requirement was originally awarded by task order and the contractor identified a differing site condition.
The structural rafter tail replacement is not within the scope of the IDIQ contract. Construction is needed at once to preserve the structure and protect the health and welfare of employees.
The proposed contract action will not be synopsized. IAW FAR 5.202 (a)(2), the proposed contract action is made under the conditions described in 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in 5.203.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Price fairness and reasonableness will be determined IAW FAR 15.404-1 (b)(2)(vii), analysis of data other than certified cost or pricing data provided by the offeror. The contractor has provided certified cost and pricing data for evaluation.
The work required is extensive and pricing will be negotiated to obtain the best value for the government.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
No market research was conducted for this differing site condition. To preserve the structure of Army Medical Command Headquarters, the Government has an unusual and compelling need to expedite structural rafter tail replacement and complete the roof.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
The mold accumulation and frequent rain fall has created an unusual and compelling situation that impacts Army Medical Command Headquarters and the health and welfare of the personnel assigned to the facility. The 502 Civil Engineering Project Manager has identified an estimated $63,641.31 of water damage inside the facility. Although this value is minor compared to the total task order increase, the real unusual and compelling need is the mission impact and health and welfare of building personnel. Army Medical Command leadership and personnel have significant concerns over working in a facility with accumulated mold development. Displaced personnel will significantly impact Army Medical Command worldwide capability. It is in the best interest of the government to utilize the contractor who is currently working on this roof to expedite demolition, repair, and replacement. The possibility of displaced personnel and the worldwide implications is not an option for Army Medical Command. Utilizing an alternate structural contractor may delay total roof repairs.
In conclusion, this new work is considered a differing site condition IAW FAR 52.236-2 (a)(i). The contractor could not have anticipated the rotten structural rafters and it is in the best interest of the government to utilize the current contractor to complete all roof work. This requirement is unusual and compelling to protect personnel health and welfare, safety, and continue Army Medical Command Headquarters worldwide mission capabilities. The Contracting Officer has determined this modification as the optimal solution to streamlining roof replacement.
X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The AFICA Roofing IDIQ is focused for roof repair only and not structural repair. To insure future requirements do not sustain this differing site conditions, Civil Engineering and Contracting will team to conduct more extensive research on the existing conditions of roofing requirements.
