About this file
This document contains a justification and approval for using other than full and open competition to procure dormitory/quarters style furniture, soft goods, and installation and removal services for Headquarters Battery Barracks at 10th Marine Regiment aboard Marine Corps Base Camp Lejeune in North Carolina. The requirement includes brand name or equal items such as a microwave/fridge combo, multifunction task chair, bed mattress, comforter/blanket, area rug, drapery with hardware, lift deck bed, night stand, secretary wall unit/wardrobe, lounge chair, bar height stool, bench/ottoman, and bar height round table. The justification cites regulatory guidance requiring integrated interior design and a whole room concept, and market research found no fully competitive sources that can meet all requirements. A pre-solicitation notice will be posted to solicit offers for the supplies and services with the intention to issue a firm fixed price contract as an unrestricted acquisition using simplified acquisition procedures.

4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. Section 2304(c)(1), one source or limited sources.
5. Rationale Justifying Use of Cited Statutory Authority. Governing regulatory guidance found in the Department of Defense’s Unified Facilities Critera for Interior Design (UFC 3-120-10) and the Marine Corps Policy on Family and Bachelor Housing Management (MCO 11000.22 CH1 V2) directs developing interior design requirements of Furniture, Fixture, and Equipment (FF&E) be integrated with a facility’s Structural Interior Design (SID).
All provided specifications coordinatye with NAVFAC and ROICC’S SID/paint schemes. The required Whole Room Concept (WRC) includes individual whole-room packaging to accommodate high-volume installation. Market research has not identified a fully competitive market that can provide a complete WRC that meets all requirements (e.g. specifications, design, and packaging).
Through an Integrated Product Team (IPT) approach, multiple stakeholders to include, but not limited to, NAVFAC Interior Designers (ID), other departments, Marines, and manufacturers provide recommendations into design of projects. Regulat evaluation of prior projects, best practices, interior design improvements, end-user comments, etc. are employed and are assisting our efforts to not only narrow the gap between MilCon and FSRM project interior designs, but also move us towards a more coordinate and standardized inventory packages for the Bachelor Enlisted Quarters (BEQs). The modest standardized packages contribute to reduces number of manufacturers for like items, support interchangeability of parts where applicable, and minize the amount of warranty procedures the Base Property Office must manage based upon fiscal, regulatory, and administrative constraints.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible. The Department of the Navy (DON) released guidance in May 2021 concerning Tiered Contracting Solutions that dissolved the use of existing policies concerning furniture. This allows for procurement options outside the previous practice utilizing Navy Blanket Purchase Agreements (BPAs) only. Although limited, market Research has found that there are some vendors capable of providing all items and services required through the Federal Supply Schedule (FSS) and within the Open Market. To ensure ample competition and opportunity is available, this requirement will be posted on the Open Market.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable based on competitive offers.
8. Actions to Remove Barriers to Future Competition. For the reasons set forth in Paragraph 5, the Government has no plans at this time to eliminate brand name or equal items from future solicitation for the supplies/services covered in this document; however, the requirement for brand name of equal items will be reassessed during follow-on acquisition planning events.
