Competition

10 U.S.C. 2304(b)(2) in furtherance of the Small Business

Act (15 U.S.C. 638).

5. Rationale Justifying Use of Cited Statutory Authority

Over the last sixteen years, SEA CORP worked to develop the capability to connect to the

In December 2009, a five year Phase III SBIR NUWCDIVNPT

Contract, , was awarded to SEA CORP to fully apply the data collection/analysis capabilities developed in the Phase I &

II SBIRs and to further develop and improve the XTDAS system into a compact, ruggedized, fullyoperational system that interfaces with multiple . The software complexity of the XTDAS system has evolved to a multifaceted system with hundreds of thousands of lines of code. In 2014, this effort was extended an additional five years with Phase III SBIR NUWCDIVNPT Contract, N

As stated in the Small Business Administration SBIR Policy

Directive, the competition for SBIR Phase I and Phase II awards satisfies any competition requirement of the Armed

Services Procurement Act, the Federal Property and

Administrative Services Act, and the Competition in

Justification and Approval pursuant to FAR 6.302-5, that the project is a SBIR Phase III award that is derived from, extends, or completes efforts made under prior SBIR funding agreements and is authorized under 10 U.S.C. 2304(b)(2) or

41 U.S.C. 3303(b)

Under this effort the contractor will update the XTDAS

System for every new submarine TI/APB configuration that is fielded to the fleet. Therefore, the services to be performed on the proposed sole source contract qualify as an

SBIR Phase III effort that derives from, and extends efforts, to continue development and improvement of the

XTDAS system under the previous SBIR contract and funding agreement, . The proposed Phase

III sole source contract is therefore authorized under 10

U.S.C. 2304(b)(2) or 41 U.S.C. 3303(b).

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

As described above, only SEA CORP is considered for this award due to the nature of the acquisition. Synopsis of this requirement will be posted to the Government Point of

Entry. Any challenges to the sole source nature of this acquisition will be brought to the attention of the

Approving Authority prior to contract award.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine prior to award that the negotiated cost plus fixed fee of the contract executed under this justification is fair and reasonable pursuant to

FAR Subpart 15.4. This determination will be documented in a Business Clearance Memorandum that will be included in the contract file.

8. Actions to Remove Barriers to Competition

No actions have been taken to remove barriers to competition. SEA CORP developed the XTDAS under the SBIR program, and its continued performance constitutes an SBIR

Phase III contract. Per the Small Business Administration

SBIR Policy Directive, to the greatest extent practicable, agencies shall issue Phase III awards relating to technology, including sole source awards, to the SBIR
