About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for a simplified acquisition of various Volvo Penta engine parts for U.S. Coast Guard vessels. The procurement covers multiple engine parts used for maintenance and upkeep of installed engines on Coast Guard boats, including a 32-foot Tactical Patrol Shallow-Draft (TPSB) vessel and other multi-vessel platforms. The parts are critical to maintaining proper engine operations and vessel maneuverability, with the inability to repair engines potentially jeopardizing crew and vessel safety.

The justification establishes a brand name sole source procurement under FAR 13.106-1(b)(1), limiting offers to Volvo Penta of the Americas, Inc. as the Original Equipment Manufacturer (OEM). The rationale centers on the unavailability of technical data, manufacturing drawings, specifications, tolerances, and test procedures required to assess equivalent parts, combined with the operational criticality of the components. Any attempt to manufacture or source non-OEM parts without proper technical documentation could result in mission degradation and safety risks. The contracting officer used market research, comparison with previous purchases, and current price lists to determine fair and reasonable pricing. The document was signed on February 4, 2026, by Technical and Requirements POC Steven A. Bolen and Contracting Officer Bryan Anthony Duffey.

RATIONALE FOR JUSTIFICATION TYPE SELECTED ABOVE TO INCLUDE RELEVANT INFORMATION GAINED THROUGH YOUR MARKET RESEARCH TO SUPPORT THE JUSTIFICATION TYPE:

The technical data for the VARIOUS ENGINE PARTS required in making an accurate assessment of equal or alternate equipment that could meet the Coast Guard’s performance, fit, form and function requirements in this procurement is unavailable. The VARIOUS ENGINE PARTS are utilized in maintenance and upkeep of the installed engines. The VARIOUS ENGINE PARTS are critical to maintain proper engine operations. The engine provides power to the jet drives, giving the vessel the capability to move in all directions or maintain a hold position. The inability to maneuver would place the boat in an untenable situation while underway, jeopardizing the safety of the crew and vessel. VOLVO PENTA of the AMERICAS, INC., brand, VARIOUS ENGINE PARTS, are installed on this platform, Coast Guard boats. Any attempt to manufacture these items without the proper access to Original Equipment Manufacturer (OEM) reproduction manufacturing drawings, spec, tolerances/parameters, test procedures and other relevant information, could lead to a major mission degradation. Therefore, any offer of parts shall be “official OEM brand”.
