About this file
This document is a Justification for Other Than Full and Open Competition (JOTFOC) for a sole source procurement of Monitoring and Inspection (M&I) Architect and Engineering (A&E) services for the Baton Rouge Federal Courthouse construction project. The solicitation is for PDG, Inc. to provide M&I services for the 4th Courtroom on the 3rd Floor, with a period of performance matching the ongoing construction project (47PH0525F0062). The total procurement value is under $750,000, and the justification cites FAR 6.302-1 as the statutory authority, indicating PDG, Inc. is the only responsible source that can satisfy agency requirements.
The sole source selection is based on PDG, Inc.'s prior involvement in designing the original project under a now-expired GSA regional Indefinite Delivery Indefinite Quantity (IDIQ) contract. The government argues that soliciting through other means would incur additional costs and potentially delay the construction project. No market research was conducted, and no other sources will be solicited. The contracting officer has determined this approach is in the best interest of the government, with price reasonableness to be determined through comparison with the Independent Government Estimate and historical pricing for similar regional M&I projects.

DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED
Contract Task Order 47PH0525F0062 was awarded on March 10, 2025, for construction services at the Baton Rouge Federal Courthouse. The design for this project was done by PDG, Inc. under GSA’s regional Indefinite Delivery Indefinite Quantity contract, which has now expired. Due to the current Government’s downsizing and re-structuring, it has been determined that M&I services are needed for this construction project. Additionally, personnel downsizing has delayed the award of GSA’s new regional IDIQs and they are not expected to be awarded until months from now. It is highly recommended that this M&I project be solicited and directly awarded to PDG, Inc. based on the following.
1. Logical Follow project. PDG, Inc. is familiar with the project as they were the A&E firm that designed the project. Soliciting this project through other means would mean additional costs for the Government that are not expected to be recovered through competition.
Soliciting this project through other means would also delay the current construction project that has already been awarded and needs these services immediately or risk construction delays.
