About this file
This document is a Justification for Other Than Full and Open Competition (JOTFOC) for a succeeding lease of office and related space for the General Services Administration (GSA) in Greensboro, North Carolina.
The GSA currently leases 16,526 ABOA/18,984 rentable square feet of office and related space at 6005 Landmark Center Blvd, Greensboro, NC under lease number GS-04B-LNC59153. The current lease expires on 5/31/2024, and the GSA is requesting approval to negotiate a succeeding lease with the incumbent lessor without full and open competition. The estimated cost of this 10-year/5-year firm term lease is $24.33 per rentable square foot per year for an annual cost of $461,880.72 and a total contract value of $4,618,807.20. The GSA conducted market research and advertising, but did not identify any potentially acceptable locations besides the incumbent. Therefore, the GSA is justifying a sole source award to the incumbent lessor under 41 U.S.C. 3304(a)(1) as only one responsible source is available.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402-1(1) and GSAR 570-402-4 (no potentially acceptable locations). In accordance with GSAR 570.402-1(1) and GSAR 570.402-4, use of this sole source authority is appropriate when the contracting officer does not identify any potentially acceptable locations through advertisement or market survey.
4.
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
It is in the best interest of the Government to remain at the current location. No other potentially acceptable locations were identified through public advertisement or market survey/research besides the incumbent. The GSA Broker placed an advertisement on the Contracting Opportunities domain of SAM.gov on 11/14/23 with a closing date of 12/05/2023, but no expressions of interest were received other than
. In addition, market research using CoSt within the prescribed delineated area that might meet locations were identified. When no potentially acceptable locations are identified through advertisement or market survey, GSAR 570.402-4 allows for negotiation with the incumbent Lessor.

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

In addition, Broker also conducted market research using CoStar and placed calls to assess viability of sites found within the delineated area. Although two properties were initially identified, they were determined unacceptable because one was under lease with another tenant and the other was not interested in leasing to such, no potentially acceptable locations were identified and no expressions of interest were received, besides incumbent.
6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE
GOVERNMENT WILL BE FAIR AND REASONABLE.
Recent market Greensboro, NC showed the rental rate within the delineated area ranges from per RSF to per RSF fully serviced, net of a tenant improvements allowance. This market information was obtained from CoStar listings in Greensboro, NC.
Therefore, the projected rental rates for this succeeding lease of per rentable square feet (net of tenant improvements or a BSAC allowance) are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.
7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.
GSAR 570.402-4 allows for negotiation with the incumbent Lessor when the Lease Contracting Officer does not identify any potentially acceptable locations through advertisement or market survey.
