DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

3. Description of Supplies/Services and Estimated Cost.

This requirement is for refuse services for facilities under the Mid-Pacific Region, South- Central California Area Office- Tracy Field Offices (SCCAO-TO). The requested services will consist of the supply of containers for waste and recyclables and a combination of weekly and on-call scheduling for pick-up and disposal services for three separate locations within a three-mile radius. The 3 locations are within the county of San Joaquin:

1) Administration Building - 16650 Kelso Rd, Byron, CA

2) Garage Building - 16800 Kelso Rd., Byron, CA

3) Ops & Maint. Building - 6525 Lindermann Rd., Tracy, CA

The period of performance is as follows:

Base Year: February 10, 2021 – February 9, 2022 Option Year 1: February 10, 2022 – February 9, 2023 Option Year 2: February 10, 2023 – February 9, 2024 Option Year 3: February 10, 2024 – February 9, 2025 Option Year 4: February 10, 2025 – February 9, 2026

4. Description of Circumstances, including why only one source is reasonably available.

San Joaquin County Public Works does not provide collection services, instead this service is franchised to multiple private hauling companies with specific areas or cities for operations.

Tracy Delta Solid Waste Management, Inc. is the designated hauling company for Tracy/Byron, CA area.

5. Determination of Fair and Reasonable Price.

6. Description of Market Research.

A search for county or city services for refuse services and a review of contract history revealed that Tracy Delta Disposal has been the sole provider of this service. It was discovered that San Joaquin county franchises this operation to private companies that operate in different cities throughout the county. Currently there are seven different companies: California Waste Recovery Systems (Galt, CA), Central Valley Waste Services (Lodi, CA), Allied Waste and Stockton Scavengers Assc. (Stockton, CA), Gilton Solid Waste Management, Inc. (Oakdale, CA), Roos Disposal (Ripon, CA), and Tracy Delta Disposal Service (Tracy, CA).

The Contracting Officer will determine fair and reasonableness with the techniques IAW FAR 13.106-3(a)(2). The Bureau of Reclamation has had previous contracts with this vendor for the same or similar services. A comparison of proposed prices and past services will be conducted to evaluate price fairness and reasonableness
