About this file

This document is a Justification and Approval for Other Than Full and Open Competition (JOTFOC) under FAR 6.302-1. It describes a firm-fixed-price purchase order for trash/garbage pick-up and disposal services at Hoover Dam, with a base year beginning 10/01/2024 and up to 4 option years, for an estimated base year cost of $120,000.

The agency is the Department of the Interior, Bureau of Reclamation. The sole-source justification cites 41 U.S.C. 3304(a)(1) - only one responsible source. The proposed contractor is Boulder Disposal Inc., the only commercial service provider for these services in the local area. Market research confirmed there are no other sources. The cost is deemed fair and reasonable based on comparison to similar historical contract awards. The JOTFOC was posted on the GPE, but no responses were received.

(04/2021)

Boulder Disposal Inc (UEI: JP45AANMBCQ3) 7197 Durango ST Las Vegas, NV 89120

The proposed contractor is the only commercial service provider for these services in the local area. While there are residential services several miles from the site, the City of Boulder City will not service the commercial sites.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)).

A notice of intent to sole source was posted on the GPE (SAM.gov) on 08/23/2024 and requested responses 6 calendar days later. This was not posted for the typical time of 14 calendar days. Due to fiscal year end time restrictions and the need to put this contract in place to continue services from the former contract ending 09/30/2024, the CO determined that the reduced time is sufficient for this requirement. No responses were received and none are expected, but any that are received will be considered up to the award date (est.

09/13/2024), as it will remain publicly viewable on the GPE for another 15 calendar days.

Additional market research was performed to validate that there is still only one source who can perform the required trash pick-up and removal services at Hoover Dam.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)).

The anticipated cost will be considered fair and reasonable based on the comparison of proposed prices for similar services and historical prices for the same or similar services.

The agency has another similar contract award with the contractor for services at the Boulder City properties, along with historical awards for the same services that can be used for comparison.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)).

For this new contract, market research included validating that information by searching for any new information that was not already known from the historic purchases and posting a notice of intent to sole source on the GPE.

9. Any Other Supporting Facts (FAR 6.303-2(b)(9)).

Boulder Disposal Inc is the only company that can provide commercial trash removal services in the area. Historically, Boulder Disposal Inc has been the only company that can provide the services needed by non-residential entities in the local area for over 15 years.

10. Listing of Interested Sources (FAR 6.303-2(b)(10)).

Boulder Disposal Inc. is the only offeror who has expressed the ability and interest to perform these services.

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11)).

On future requirements for trash pick-up services, additional market research will continue to be completed to identify any new contractors or change in local policies.
