SIMPLIFIED ACQUISITION PROCEDURES (SAP) JUSTIFICATION FOR OTHER THAN FULL
AND OPEN COMPETITION (J&A)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE
CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.
STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
PURCHASE REQUEST OR REQUISITION NUMBER
2120480PCLBF6
PROJECT/TASK NUMBER
OVHC2IMM
ESTIMATED AMOUNT (OVER $2,500 BUT
NOT EXCEEDING $100,000)
BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRE, AND THE INTENDED USE.
The Electronic Standby Instrument System (ESIS) PN 10-6554 is a simulated version of the aircraft ESIS component (NSN 6610-01-545-0766). 2ea SIMTEK 10-6554 ESIS indicators are currently installed in the MH60T Cockpit Procedures Flight Trainer (CPT). The ESIS provides backup instrumentation of the navigational equipment;
including altimeter, airspeed indicator, and attitude indicator. The USCG does not own a spare/backup SIMTEK ESIS components for the MH60 CPT. This procurement is for 3ea SIMTEK ESIS indicators, 2ea for the MH60 Operational Flight Trainer and 1ea to provide as a spare/backup for either the MH60 OFT or MH60 CPT trainers.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES
CAN BE USED.
The Coast Guard does not own specifications, drawings, and related data for the Electronic Standby Instrument System Panel to permit full and open competition. SIMTEK is the manufacturer of the ESIS 10-6554. Utilizing a different manufacturer would require simulator rewiring, programming and hardware changes and prevent component installation without configuration changes and prevent standardization between the simulators.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
SIMTEK is the Original Equipment Manufacturer (OEM) of the 10-6554 ESIS panel, and remains the only business entity that has all the required proprietary rights that are necessary to design, develop, manufacture, upgrade or repair this instrument. Authority: FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN
COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
SIMTEK is the manufacturer of the installed Electronic Standby Instrument System Panel on the MH60T Cockpit Procedures Trainer. Only the SIMTEK ESIS panel will operate in the current simulator configuration without software programming and/or hardware changes.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
Based on the nature of this requirement, there are no cost effective actions the USCG can take to remove or overcome barriers for the competition for the manufacturer of this requirement. SIMTEK maintains ownership and custody of proprietary engineering and manufacturing information. Complete specifications and drawings are not available to reverse engineer or modify the existing ESIS. The USCG does not own the data rights and does not anticipate purchasing these data rights as this would be cost prohibited.
