JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
Services requested includes verification of the MAESTRO Wave loading and structural analysis approach for Coast Guard cutters. The MAESTRO Wave hydrodynamic loading approach developed by MAESTRO MARINE and related analysis tools are only available form MAESTRO MARINE.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER
SUPPLIES OR SERVICES CAN BE USED.
MAESTRO Marine has developed the MAESTRO structural evaluation software including the MAESTRO Wave hydrodynamic loading module used by the USCG for hull structural evaluations; therefore, MAESTRO Marine is uniquely qualified to further develop the MAESTRO software for USCG cutters needed to fulfill the objectives of the project. No other source has the models, prior analysis or knowledge to reproduce or conduct the required services.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).
MAESTRO Marine has developed the hydrodynamic analysis approach used by the USCG for structural evaluations of surface assets. It is not possible for another contractor to develop an approach for structural analysis and verification of the approach without major expense and duplication of effort. An internet search does not provide any information that will be useful in identifying capabilities and services required due to the nature of the system developed by MAESTRO Marine.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
MAESTRO Marine has developed the MAESTRO models and hydrodynamic loading approach the USCG uses for the evaluation cutter hull structural corrosion needed to fulfill the objectives of the project. Additionally, MAESTRO Marine has produced the MAESTRO Wave approach needed to for the USCG to use in structural evaluations of USCG cutter hull structure.
No other source has the proprietary knowledge of the MAESTRO software, models, prior analysis or knowledge to reproduce or conduct the required services.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL
AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
MAESTRO Marine has developed the MAESTRO analysis approach and software used by the USCG to evaluate hull structure hydrodynamic loading in USCG cutters needed to fulfill the objectives of the project; therefore, a purchase description cannot be written to overcome this for this effort.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY
BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
It is not possible to remove or overcome barriers because the contractor is the MAESTRO software developer and knowledge of the MAESTRO analysis approach, there is nothing the government can do to remove the barriers for open competition for this effort.
