About this file

This is a Justification and Approval for Other Than Full and Open Competition document for a simplified acquisition under the Federal Acquisition Regulation (FAR 13.106-1).

Yosemite National Park is procuring repair and reprogramming services for the Programmable Logic Control (PLC) system of two Alfa Laval DS-308 centrifuges at the El Portal Wastewater Treatment Facility (EPWWTF), a one-million-gallon-per-day treatment plant serving Yosemite Valley and El Portal. The centrifuge system, previously installed under contracts P8522P0053 and P8525P0062, has developed persistent communication faults, illuminated alarms, and operating errors that remain unresolved despite electrical module replacements by NPS staff. The facility's only backup biosolids management system (sludge drying beds) has been taken out of service during a multi-year plant rehabilitation, making the centrifuges critical to preventing sanitary sewer overflows. The estimated cost for the repair, onsite programming, recalibration, and system correction is $13,622.00, with PR Number 44053000 and an acquisition date of July 1, 2026.

The contracting officer justified a sole source award under FAR 13.106-1 based on the availability of only one responsible source. Alfa Laval is the Original Equipment Manufacturer (OEM) of the DS-308 centrifuges and holds proprietary or patented control over all parts, technology, system components, communication modules, and control architecture. Only Alfa Laval-certified personnel are authorized to install or service OEM parts, and no other vendor can legally manufacture or provide OEM parts or service. Although Alfa Laval does not directly employ PLC programmers, all PLC programming and control systems work is performed exclusively through Systems East Inc, their sole authorized subcontractor and programming integrator for Alfa Laval DS-308 systems. Market research confirmed no other vendors possess legal authority, access to proprietary logic blocks, or the capability to service or modify Alfa Laval's patented components. The sole source justification was approved by Katie Bablitch (Project Officer) and Timothy D. Modjeski (Contracting Officer) on July 9, 2026, with certification that fair and reasonable pricing will be determined using FAR Part 13.106-3(a) price analysis techniques.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2500 for Construction/Services)

AND UP TO $150,000

(See FAR 13.106-1)

Date: 7/1/2026 PR Number:

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Yosemite National Park operates the El Portal Wastewater Treatment Facility (EPWWTF), a one-million-gallon-per-day treatment plant serving Yosemite Valley and the town of El Portal.

The facility relies on two Alfa Laval DS-308 centrifuges for biosolids dewatering, a critical and non-redundant process essential for preventing sanitary sewer overflows.

The centrifuge Programmable Logic Control (PLC) system—rehabbed and installed under contracts P8522P0053 and P8525P0062—has developed persistent communication faults, illuminated alarms, and operating errors. Multiple electrical modules were replaced by NPS staff;

however, the errors remain. The warranty period has expired and onsite programming, recalibration, and system correction are required to restore operations.

During the upcoming multi-year plant rehabilitation, sludge drying beds have been taken out of service, eliminating the Park’s only backup biosolids management system. Failure to restore the centrifuges to full operational status will result in an immediate risk of wastewater system failure and potential sanitary sewer overflow.

Estimated Cost: $13,622.00

2. Sole Source Justification rationale (Check one and explain below):

__X_ Only one responsible source.

_____ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

The centrifuges installed at EPWWTF are proprietary Alfa Laval DS-308 units. Alfa Laval has provided written confirmation that:

• They are the Original Equipment Manufacturer (OEM) of the DS-308 centrifuges installed at El Portal.

• All parts, technology, and most system components (including communication modules and control architecture) are proprietary or patented.

• Only Alfa Laval-certified personnel are authorized to install or service OEM parts;

unauthorized work voids the warranty.

• No other vendor can legally manufacture or provide OEM parts or service for this equipment.

Although Alfa Laval does not directly employ PLC programmers, all PLC programming and control systems work on Alfa Laval centrifuges is performed only through their authorized subcontractor. When the centrifuge control system was installed and programmed under prior contracts, Alfa Laval subcontracted all PLC programming, SCADA integration, and system commissioning to Systems East Inc, who remains the sole authorized programming integrator for Alfa Laval DS-308 systems.

Due to proprietary configuration, patented control logic, and warranty restrictions, only Alfa Laval and its authorized integrator can legally and technically perform the required repairs.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Market research confirms that:

• Alfa Laval is the only OEM for DS-308 centrifuges and the only authorized provider of parts and service.

• Alfa Laval historically subcontracted all PLC programming to Systems East Inc during previous installations and confirmed verbally that programming is not performed by any other contractor. Alfa Laval declined to provide written confirmation but reaffirmed their exclusive control over OEM equipment and service.

• No other vendors have legal authority, access to proprietary logic blocks, or the ability to service or modify Alfa Laval’s patented components.

Because the control hardware and software architecture is proprietary and tied directly to OEM warranty and performance requirements, no other vendor is capable of providing the required repairs.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
